【摘要】： 中國是一個農(nóng)業(yè)大國,農(nóng)村問題歷來是中國的根本問題之一。在當代中國,和諧新農(nóng)村建設是和諧社會建設的重要組成部分;而農(nóng)村法制建設是和諧新農(nóng)村建設的重要組成部分。加強農(nóng)村法制建設不僅是和諧新農(nóng)村建設的重要內(nèi)容,更是和諧新農(nóng)村建設的有力保障。然而,長期以來,我國理論界對農(nóng)村法制建設問題關注不多,成果甚少。本文對我國農(nóng)村法制建設的現(xiàn)狀進行分析,在借鑒國外經(jīng)驗的基礎上,提出了完善我國農(nóng)村法制建設的幾點對策,以期活躍對這一重大問題的研究。 除引言外,本文共分四大部分。 第一部分是和諧新農(nóng)村與法制建設的基本內(nèi)涵及其相互關系。包括和諧新農(nóng)村與法制建設的基本內(nèi)涵、和諧新農(nóng)村建設與法制建設的關系等問題的分析。 第二部分是我國和諧新農(nóng)村法制建設的現(xiàn)狀及成因。包括現(xiàn)階段我國和諧新農(nóng)村法制建設取得的成就、存在的問題及其成因等問題的論證。 第三部分是國外農(nóng)村法制建設及其對我國農(nóng)村法制建設的啟示。包括日本、美國、韓國農(nóng)村法制建設的概況以及對我國農(nóng)村法制建設的啟示等問題的分析。 第四部分是完善和諧新農(nóng)村法制建設的對策。具體包括加強農(nóng)村立法水平、完善農(nóng)村法律體系,完善農(nóng)村執(zhí)法體系、確保嚴格高效執(zhí)法,完善農(nóng)村司法體系、確保司法公正,全面增強農(nóng)民群眾的法律素質四個方面。
[Abstract]:China is an agricultural country, the rural problem is one of the essential problems in the contemporary China. Chinese, the construction of harmonious new countryside is an important part of the construction of a harmonious society; and the legal system construction is an important part of the construction of harmonious new countryside. To strengthen the legal construction in rural areas is not only an important part of the construction of harmonious new countryside, it is guarantee the construction of harmonious new countryside. However, for a long time, the theory circle of our country pay attention to legal construction in rural areas is not much, little achievement. The status of rural legal construction in China are analyzed, on the basis of the experience abroad, put forward how to perfect the rural legal construction of our country countermeasure research on the major issues in the active period.
In addition to the introduction, this article is divided into four parts.
The first part is the basic connotation of harmonious new countryside and legal system construction and their relationship, including the basic connotation of harmonious new countryside and legal system construction, the analysis of the relationship between new rural construction and legal system construction.
The second part is the current situation and causes of the legal system construction of the harmonious new countryside in China, including the achievements, problems and causes of the new rural harmonious legal system construction at present stage.
The third part is about the construction of rural legal system in foreign countries and Its Enlightenment to China's rural legal system construction, including the general situation of rural legal system construction in Japan, the United States, South Korea, and the enlightenment to China's rural legal system construction.
The fourth part is the countermeasures to perfect the harmonious new countryside legal construction. Including strengthen the legislative level, improve the rural legal system, improve the rural law enforcement system, to ensure the strict and efficient law enforcement, improve the rural judicial system, ensure judicial justice, strengthen the four aspects of peasants' legal quality.
