【摘要】：改革開放以后,城市外來(lái)務(wù)工青年的流動(dòng)量逐年增加,外來(lái)務(wù)工青年的管理便逐漸成為社會(huì)各方面關(guān)注的焦點(diǎn)。在外來(lái)務(wù)工青年總量增加的同時(shí),外來(lái)務(wù)工青年的數(shù)量也不斷增多,對(duì)他們的教育、管理已經(jīng)成為當(dāng)前我國(guó)許多城市亟待解決的社會(huì)問題�，F(xiàn)階段,外來(lái)務(wù)工青年犯罪日趨嚴(yán)重,犯罪率逐年上升,呈現(xiàn)出低齡化、低文化,犯罪隨意性大、暴力程度加劇、團(tuán)伙作案等特點(diǎn)。分析影響外來(lái)務(wù)工青年犯罪心理的因素,對(duì)于從根本上預(yù)防外來(lái)務(wù)工青年犯罪,進(jìn)而降低外來(lái)務(wù)工青年整體犯罪率,維護(hù)社會(huì)穩(wěn)定,構(gòu)建和諧社會(huì)具有重要意義。 外來(lái)務(wù)工青年犯罪心理的生成有其主體和環(huán)境兩方面的原因。主體方面受錯(cuò)誤的人生觀、不健全的認(rèn)知結(jié)構(gòu)、較差的消極情緒控制能力、明顯的個(gè)體矛盾性、法律意識(shí)淡薄、較低的犯罪感等因素的控制;環(huán)境方面受家庭因素、學(xué)校因素、社會(huì)因素等因素的影響。全面分析這些因素,有助于了解外來(lái)務(wù)工青年犯罪心理產(chǎn)生的原因和演進(jìn)過(guò)程,對(duì)防范外來(lái)務(wù)工青年犯罪大有裨益。我們還可以通過(guò)追尋外來(lái)務(wù)工青年犯罪的心理軌跡來(lái)判斷他們走向犯罪道路的成因。 當(dāng)然無(wú)論外來(lái)務(wù)工青年犯罪心理成因究竟如何,最重要的還是找到防治這些犯罪心理產(chǎn)生的方法。因?yàn)槿魏我环N犯罪行為都受其犯罪心理的支配和制約。從分析和研究外來(lái)務(wù)工青年犯罪,可以看出產(chǎn)生犯罪心理的原因一般是受環(huán)境影響下,不良心理逐漸累積形成。所以要防止產(chǎn)生犯罪的心理,心病還需心藥治。首先進(jìn)行心理上的預(yù)防,其次要加強(qiáng)心理上的教育,當(dāng)然,運(yùn)用一定的法制手段進(jìn)行對(duì)外來(lái)務(wù)工青年行為的規(guī)范也是必要的。最后通過(guò)心理咨詢、心理治療、行為療法等手段來(lái)促使外來(lái)務(wù)工青年的心理發(fā)生積極的變化。本文旨在思考我國(guó)當(dāng)前外來(lái)務(wù)工青年犯罪心理的現(xiàn)狀,從而為如何解決這一棘手問題找到一些思路。
[Abstract]:After the reform and opening up, the flow of young migrant workers in urban areas has increased year by year, and the management of young migrant workers has gradually become the focus of attention in all aspects of the society. With the increase of the total amount of migrant workers, the number of migrant workers is also increasing. The education and management of migrant workers has become a social problem which needs to be solved in many cities of our country. At present, the crimes committed by young migrant workers are becoming more and more serious, the crime rate is increasing year by year, showing the characteristics of low age, low culture, large random crime, intensified violence, gang crime and so on. It is of great significance to analyze the factors that affect the criminal psychology of young migrant workers in order to prevent the crime of young migrant workers fundamentally, then reduce the overall crime rate of young migrant workers, maintain social stability, and build a harmonious society. The generation of young migrant workers' criminal psychology has two reasons: the subject and the environment. The subject is controlled by such factors as wrong outlook on life, imperfect cognitive structure, poor negative emotion control ability, obvious individual contradiction, weak legal consciousness, lower sense of crime, and so on. Environmental factors are affected by family factors, school factors, social factors and other factors. An overall analysis of these factors is helpful to understand the causes and evolution of the criminal psychology of young migrant workers and to prevent the youth migrant workers from committing crimes. We can also judge the cause of the young migrant workers' criminal path by tracing the psychological track of their crimes. Of course, no matter what the cause of criminal psychology of migrant workers is, the most important thing is to find a way to prevent and cure these criminal psychology. Because any kind of criminal act is controlled and restricted by its criminal psychology. From the analysis and study of the crimes committed by young migrant workers, we can see that the reason for the criminal psychology is that the bad psychology gradually accumulates under the influence of the environment. Therefore, in order to prevent the occurrence of criminal psychology, heart disease also needs to be treated with heart medicine. First of all, psychological prevention should be carried out, and then psychological education should be strengthened. Of course, it is necessary to use certain legal means to regulate the behavior of young migrant workers. Finally, through psychological counseling, psychotherapy, behavioral therapy and other means to promote the migrant youth psychological changes. The purpose of this paper is to think about the current situation of the criminal psychology of young migrant workers in our country, so as to find some ideas for how to solve this thorny problem.
