【摘要】：人民與敵人是兩個部分對立的概念,其內(nèi)涵與范疇在不斷變化。在社會主義建設(shè)階段,人民成為主體,敵對分子與敵對勢力仍然存在,其以政治利益、階級利益對立為區(qū)分。人的行為是否犯罪,是以觸及刑法與否為界限,同樣體現(xiàn)著階級意志,既包含一般性犯罪,也包括政治犯。法治強調(diào)以法為治,現(xiàn)行警務(wù)必須重塑警務(wù)理念,從敵人警務(wù)體系走向犯罪警務(wù)體系。
[Abstract]:The people and the enemy are two parts of the opposite concept, its connotation and category are constantly changing. In the stage of socialist construction, the people became the main body, and the hostile elements and hostile forces still existed, which were distinguished by the opposition of political interests and class interests. Whether a person's behavior is a crime or not is to touch the criminal law or not, and it also embodies the class will, including both general crime and political prisoners. The rule of law emphasizes the rule of law, and the present policing must reshape the concept of policing, from the enemy policing system to the criminal policing system.
