【摘要】： 當前,我國正處于社會轉(zhuǎn)型和體制轉(zhuǎn)換時期,經(jīng)濟體制深刻變革,社會結(jié)構(gòu)深刻變動,利益格局深刻調(diào)整,思想觀念深刻變化。這種空前的社會變革,給我國發(fā)展進步帶來巨大活力,同時也帶來了這樣或那樣的社會群體利益的矛盾沖突。由此因各種社會矛盾引發(fā)的群體性事件越來越多。 群體性事件無論參與人數(shù)多少、規(guī)模大小、性質(zhì)如何,都是擾亂社會秩序,危害公共安全,侵犯公民人身安全和公私財產(chǎn)安全的行為。在我國經(jīng)濟體制進一步深化改革和構(gòu)建社會主義和諧社會的今天,如何更有效地預防、處置群體性事件,已成為社會各界普遍關(guān)注的問題。 本文從法律解決機制的角度來審視群體性事件,全文共分三章。第一章從法治的視野審視群體性事件的概念、特征、類型及其原因;第二章論述了群體性事件的法律解決機制;第三章對案例進行分析,給出阻斷群體性事件的法律模式,并試圖為解決群體性事件提供一些有價值的參考論證。
[Abstract]:At present, our country is in the period of social transformation and system transformation, the profound transformation of economic system, the profound change of social structure, the profound adjustment of interest pattern, the profound change of ideology and concept. This unprecedented social change has brought great vitality to the development and progress of our country, at the same time, it has also brought contradictions and conflicts of the interests of one kind or another of social groups. As a result, there are more and more mass events caused by various social contradictions. Group events, no matter the number, size and nature of the participants, are all acts of disturbing social order, endangering public safety, violating citizens' personal safety and public and private property safety. How to prevent and deal with group events more effectively has become a common concern of all walks of life in our country today, when the economic system is further reformed and socialist harmonious society is built up, how to prevent and deal with mass incidents more effectively. This paper examines group events from the perspective of legal settlement mechanism, the full text is divided into three chapters. The first chapter examines the concept, characteristics, types and causes of group events from the perspective of the rule of law; the second chapter discusses the legal settlement mechanism of group events; the third chapter analyzes cases and gives the legal model of blocking group incidents. And try to provide some valuable reference for solving group incidents.
