【摘要】：偵查訊問中識別謊言的方法近幾十年在國外得到充分的重視,研究范式從對非言語行為的觀察到對言語行為的分析之間交互轉換。近期,通過使用證據(jù)的策略來發(fā)現(xiàn)犯罪嫌疑人陳述之間以及陳述與證據(jù)之間不一致的言詞提問方式是研究的熱點,國外學者對使用證據(jù)的時機和具體方法做了諸多實驗,實驗結果表明,使用證據(jù)在時間上以在訊問中期漸進式出示的方式更具有優(yōu)勢,而過早使用證據(jù)是在技巧性和揭謊效果方面表現(xiàn)最差的方法。漸進式的使用證據(jù)可以通過使用證據(jù)的框架矩陣獲得更好的效果。國外相關研究對國內偵查訊問中以用證識別謊言的實踐及理論研究的啟示主要有以下幾點:一是出示證據(jù)一般應在犯罪嫌疑人完成自由陳述并由偵查人員就自由陳述提出相關問題之后;二是出示證據(jù)之前要圍繞待出示的證據(jù)窮盡其辯解的可能性;三是重視對言語行為與非言語行為線索的綜合運用;四是在訊問理論研究方面要強化實證研究的方法來構建本土化的識別謊言方法。
[Abstract]:In recent decades, the methods of identifying lies in investigation and interrogation have been paid more and more attention in foreign countries. The paradigm of research has changed from observation of nonverbal acts to analysis of speech acts. Recently, it is a hot topic to use evidence strategy to find out the inconsistency between statements of criminal suspects and between statements and evidence. Foreign scholars have done many experiments on the timing and specific methods of using evidence. The experimental results show that the use of evidence is more advantageous in time in the way of gradual presentation in the middle of interrogation, while premature use of evidence is the worst method in terms of skill and lie-telling effect. Progressive use of evidence can achieve better results by using the frame matrix of evidence. The enlightenment of relevant foreign studies on the practice and theoretical research of using evidence to identify lies in domestic investigation and interrogation mainly includes the following points: first, the presentation of evidence should generally be completed in the criminal suspect free statement and the investigator on the freedom After the presentation of the relevant questions; Second, it is necessary to exhaust the possibility of justification around the evidence to be presented before presenting the evidence, third, to attach importance to the comprehensive application of the clues of speech act and nonverbal act; Fourth, we should strengthen the method of empirical research in the research of interrogation theory to construct the localization method of identifying lies.
