【摘要】： 偵查信息是偵查學基礎(chǔ)理論中的一個概念,在學術(shù)界對這一概念的界定比較混亂,不僅空洞而且眾說紛紜。有的觀點認為偵查信息等同于刑偵情報;有的觀點將偵查信息放大為刑偵工作信息;有的觀點認為其包含于犯罪信息,是偵查過程中對犯罪信息的認識程度。筆者撰寫本文的目的就是為了對這一概念進行剖析并加以界定,力求形成對偵查信息的清晰解讀,進而探討其實踐運用的原則與方法,指出運用中所存在的困境并提出了解決困境的設(shè)想。 在本文中,筆者從概念分析入手,認為偵查信息是不同于刑偵情報、犯罪信息、刑偵工作信息的獨立概念。對于與這幾個相似概念的關(guān)系,本文認為:偵查信息的范疇包括犯罪信息,包含于刑偵工作信息,是犯罪信息、來自犯罪系統(tǒng)外部環(huán)境方面與犯罪相關(guān)的信息和來自對偵查有用的各種知識信息的綜合。偵查信息與刑偵情報時間上的起點不同,刑偵情報在犯罪行為發(fā)生以后可以以一定方式轉(zhuǎn)化為偵查信息。同時筆者在分析洛卡德的物質(zhì)轉(zhuǎn)移原理存在的不足的基礎(chǔ)上提出了信息運動原理,力求對于偵查信息的產(chǎn)生及運動原理進行解析并列舉了一些學習中所遇到的案例,論證了偵查信息的內(nèi)容、特點、理論基礎(chǔ)、實踐價值、分析與運用,力求對偵查信息這一概念進行一個總體上的把握,希望能夠為偵查學基礎(chǔ)理論的研究盡一點綿薄之力。
[Abstract]:Investigation information is a concept in the basic theory of criminal investigation. The definition of this concept is confused in academic circles, which is not only empty but also has different opinions. Some view that investigation information is equal to criminal investigation information; some view that investigation information is enlarged into criminal investigation work information; some view that investigation information is included in criminal information, which is the degree of understanding of criminal information in the process of investigation. The purpose of this paper is to analyze and define this concept, to form a clear interpretation of investigation information, and then to explore the principles and methods of its practical application. This paper points out the difficulties existing in the application and puts forward a tentative plan to solve them. In this paper, the author starts with the concept analysis, thinks that the investigation information is different from the criminal investigation information, the crime information, the criminal investigation work information independent concept. For the relationship with these similar concepts, this paper holds that the scope of investigation information includes criminal information, including criminal investigation information, is criminal information, Synthesis of criminal-related information from the external environment of the criminal system and all kinds of knowledge useful for investigation. Criminal investigation information is different from criminal investigation information in time. Criminal investigation information can be transformed into investigation information in a certain way after criminal behavior occurs. At the same time, on the basis of analyzing the deficiency of Lokard's material transfer principle, the author puts forward the principle of information movement, tries to analyze the generation and movement principle of investigation information, and enumerates some cases encountered in his study. This paper demonstrates the content, characteristics, theoretical basis, practical value, analysis and application of investigation information, and tries to make a general grasp of the concept of investigation information, hoping to contribute a little bit to the research of the basic theory of investigative science.
