【摘要】：獲得合理的裁判結(jié)論最終是追求實(shí)體問(wèn)題的合理解決,但在司法實(shí)踐中往往只注重實(shí)體問(wèn)題本身,忽視了程序性證明對(duì)實(shí)體性裁判結(jié)論的影響。法律論證由實(shí)體法律論證和程序法律論證組成,通過(guò)程序法律論證體系的構(gòu)建,其所涉及的程序法規(guī)范論證、程序性事實(shí)論證、邏輯推理方法論證、程序性結(jié)論論證等能闡明其論證范圍及對(duì)實(shí)體裁判結(jié)論的影響,以獲得程序性證明體系的基本內(nèi)容和方法。
[Abstract]:To obtain a reasonable conclusion is to pursue a reasonable solution to the substantive problem, but in judicial practice, we often only pay attention to the substantive problem itself, ignoring the influence of procedural proof on the conclusion of substantive adjudication. Legal argumentation is composed of substantive legal argumentation and procedural legal argumentation. Through the construction of procedural legal argumentation system, the procedural law normative argumentation, procedural fact argumentation, logical reasoning method argumentation and procedural conclusion argumentation can clarify the scope of argumentation and its influence on the conclusion of substantive adjudication, so as to obtain the basic contents and methods of procedural proof system.
