【摘要】：對(duì)于日本地方公共團(tuán)體的立法,可從范圍與界限兩方面加以認(rèn)識(shí)。就其范圍而言,一方面,《地方自治法》采取了"自治事務(wù)"與"法定受托事務(wù)"的二分法,重構(gòu)了地方立法的事務(wù)領(lǐng)域,且伴隨著地方分權(quán)改革的推行,地方立法的事務(wù)領(lǐng)域有擴(kuò)大化的傾向;另一方面,雖然憲法規(guī)定了關(guān)于財(cái)產(chǎn)權(quán)內(nèi)容、罰則以及課稅方面的法律保留原則,但主流學(xué)說(shuō)并不排斥通過(guò)地方立法予以規(guī)定。就其界限而言,一方面,地方立法必須符合憲法對(duì)基本人權(quán)的保障;另一方面,關(guān)于地方立法是否違反上位法的判斷標(biāo)準(zhǔn),存在"法律先占論"與"最低國(guó)法論"的觀點(diǎn)對(duì)立。通過(guò)描摹日本地方立法的范圍與界限,可以為我國(guó)設(shè)區(qū)的市地方性法規(guī)的事務(wù)領(lǐng)域、地方性法規(guī)與法律保留原則的關(guān)系、地方性法規(guī)是否抵觸上位法的判斷標(biāo)準(zhǔn)等問(wèn)題提供啟發(fā)。
[Abstract]:The legislation of local public groups in Japan can be recognized from both the scope and the boundary. On the one hand, on the one hand, the local self-government has taken the dichotomy of the "self-government affairs" and the "Legal entrusted affair" to reconstruct the affairs of the local legislation, and with the implementation of the local decentralization reform, the area of the affairs of the local legislation has the tendency to be expanded; on the other hand, While the Constitution provides for the principle of the law on property rights, penalties and taxation, the mainstream doctrine does not exclude the passage of local legislation. On the one hand, on the one hand, local legislation must be in line with the Constitution's guarantee of basic human rights; on the other hand, there is a contradiction between the "the first-of-law of law" and the "the theory of the minimum state law" on whether local legislation is in violation of the judgement of the upper law. By tracing the scope and the limit of the local legislation in Japan, it can provide the inspiration for the local regulations of the city, the relationship between the local regulations and the laws, and whether the local laws and regulations are in conflict with the judgment standard of the upper-level law.
