英國過渡時期農(nóng)民主體權利的嬗變與濟貧立法

【摘要】：16世紀初至17世紀中后期傳統(tǒng)上被認為是英國從封建主義向資本主義的過渡時期。由于各種原因,英國農(nóng)民遭遇了較為普遍的失業(yè)和貧困,社會問題因之嚴重。濟貧立法應運而生。以主體權利為視角思考,可以深入解讀濟貧法建構和實踐動因。中世紀農(nóng)民的主體權利主要由土地和勞動權利二元構成。中世紀晚期農(nóng)民福利保障因土地權利的優(yōu)化和勞動權利的改善而達到歷史上的最好時期。過渡時期農(nóng)民土地權利被剝奪,勞動權利無保障,主體權利結(jié)構解體,失業(yè)、貧困、流民等社會問題尖銳。英國政府通過濟貧立法實踐試圖重構農(nóng)民主體權利,以緩解社會矛盾,此時農(nóng)民主體權利結(jié)構開始由二元結(jié)構向勞動權利為主的單一結(jié)構轉(zhuǎn)變。
[Abstract]:From the beginning of the 16 th century to the middle and late of the 17 th century, it was traditionally regarded as the transition period from feudalism to capitalism in England. For various reasons, British farmers suffered from widespread unemployment and poverty, and social problems were serious. Legislation for the relief of the poor came into being. Thinking from the perspective of subject rights, we can deeply interpret the construction and practical motivation of poverty relief law. The principal rights of peasants in the Middle Ages were mainly made up of land and labor rights. In the late Middle Ages, the welfare security of peasants reached the best time in history because of the optimization of land rights and the improvement of labor rights. In the transitional period, farmers' land rights are deprived, labor rights are not guaranteed, subject rights structure disintegrates, unemployment, poverty, displaced persons and other social problems are acute. The British government tried to reconstruct the farmers' subject rights through the practice of poverty relief legislation in order to alleviate the social contradictions. At this time, the structure of farmers' subject rights began to change from a dual structure to a single structure dominated by labor rights.
