【摘要】：芝加哥法經(jīng)濟(jì)學(xué)派在法經(jīng)濟(jì)學(xué)發(fā)展過程中占據(jù)著舉足輕重的地位。從近年法經(jīng)濟(jì)學(xué)的發(fā)展看,芝加哥法經(jīng)濟(jì)學(xué)派重新認(rèn)識功利主義和法經(jīng)濟(jì)學(xué)的關(guān)系,闡釋法經(jīng)濟(jì)學(xué)的理論起點(diǎn)和法理基礎(chǔ)是功利主義。而實(shí)證研究方法的深入推進(jìn)為法經(jīng)濟(jì)學(xué)關(guān)注行為法經(jīng)濟(jì)學(xué)和社會(huì)規(guī)范等新內(nèi)容奠定了方法論基礎(chǔ)。伴隨著法經(jīng)濟(jì)學(xué)的研究內(nèi)容日趨多元化,對行為法經(jīng)濟(jì)學(xué)和對法與社會(huì)規(guī)范的研究成為法經(jīng)濟(jì)學(xué)研究內(nèi)容的重要組成部分。芝加哥法經(jīng)濟(jì)學(xué)派的發(fā)展呈現(xiàn)出前沿性、系統(tǒng)性和針對性的特征。
[Abstract]:Chicago School of Jurisprudence plays an important role in the development of law and economics. In view of the development of law and economics in recent years, the Chicago School of Law and Economics reunderstands the relationship between utilitarianism and law economics, and explains that the theoretical starting point and legal basis of law and economics are utilitarianism. The further development of the empirical research method lays a methodological foundation for the law economics to pay attention to the behavioral law economics and the social norm and so on. With the increasing diversity of the research contents of law and economics, the study of behavioral law economics and law and social norms has become an important part of the research content of law and economics. The development of Chicago School of Jurisprudence shows the characteristics of forerunner, systematicness and pertinence.
