【摘要】：源于普通法的"私人檢察總長理論"自1943年初創(chuàng)以來,在美國民事司法體系中起到了舉足輕重的作用,已經(jīng)成為包括公民訴訟在內(nèi)的以同時保障個體利益和公共利益為目標(biāo)的訴訟類型的理論基礎(chǔ)。私人檢察總長理論對公民訴訟的影響經(jīng)歷了從《民權(quán)法案》中反歧視的民權(quán)訴訟到環(huán)境保護(hù)中的公民訴訟的延伸和發(fā)展,其法律內(nèi)涵、基本特征以及訴訟功能對公民訴訟的訴訟構(gòu)成以及訴訟機(jī)制產(chǎn)生了決定性的影響,從而將公民訴訟塑造成為美國最具代表性、最受矚目的訴訟類型。以私人檢察總長理論為基礎(chǔ)的公民訴訟不僅僅是簡單的利益保障機(jī)制,同時也是一種非常有效的執(zhí)法手段,還是對政府行政執(zhí)法的有效補充,并共同構(gòu)成了美國環(huán)境法強(qiáng)大的法律執(zhí)行體系。公民訴訟之私人檢察總長理論分析無疑會對中國未來的環(huán)境訴訟具有很重要的標(biāo)榜作用和借鑒價值。
[Abstract]:Since its inception in 1943, the "Private Attorney General's Theory", which originated from the common law, has played an important role in the civil justice system of the United States. It has become the theoretical basis of both individual and public interest litigation including citizen litigation. The influence of the private attorney general's theory on the citizen litigation has experienced the extension and development from the civil rights lawsuit against discrimination in the Civil Rights Act to the citizen lawsuit in the environmental protection, and its legal connotation. The basic characteristics and the function of litigation have a decisive influence on the constitution and mechanism of civil litigation, thus shaping the civil litigation into the most representative and attractive type of litigation in the United States. The citizen litigation based on the theory of the private procurator general is not only a simple mechanism for safeguarding interests, but also a very effective means of enforcing the law, and an effective supplement to the administrative law enforcement of the government. And together constitute a strong legal enforcement system of environmental law in the United States. There is no doubt that the theoretical analysis of the private procurator general of citizen litigation will play a very important role in the future environmental litigation in China and draw lessons from it.
