中韓商品房預(yù)售制度對比研究

【摘要】:商品房預(yù)售制度自1994年正式被我國運用以來,其以能為購房人減輕購房負(fù)擔(dān),以能為開發(fā)商解決運轉(zhuǎn)資金等問題,迅速成為我國商品房銷售市場中主要的運營手段,為我國房地產(chǎn)業(yè)的繁榮發(fā)展作出了巨大貢獻(xiàn)。然而,目前我國商品房預(yù)售制度的法律法規(guī)并不健全、完善,出現(xiàn)了滯后,出現(xiàn)了與發(fā)展脫節(jié)的情況。如,我國商品房預(yù)售資金監(jiān)管規(guī)定混亂,沒有全國統(tǒng)一規(guī)范等等問題,不禁讓我們追問如何才能有效解決商品房預(yù)售制度不完善所帶來的弊端。本文以解決我國商品房預(yù)售制度在實踐中存在的問題,試對中韓商品房預(yù)售制度進(jìn)行對比分析。希望在對比分析中,發(fā)現(xiàn)問題并得到可借鑒經(jīng)驗,完善我國商品房預(yù)售制度。 本文首先在第一章緒論當(dāng)中,對文章的研究目的與意義、研究現(xiàn)狀以及研究范圍與方法進(jìn)行全方位的闡述,意在表明本文的寫作主旨。第二章,以商品房預(yù)售制度概述角度對商品房預(yù)售制度進(jìn)行論述,涉及商品房預(yù)售的概念,商品房預(yù)售的特征、性質(zhì)以及商品房預(yù)售制度的產(chǎn)生與發(fā)展進(jìn)程,預(yù)從整體上把握商品房預(yù)售制度。第三章,以中國商品房預(yù)售制度之預(yù)售的準(zhǔn)入條件為切入口,對中國商品房預(yù)售合同備案制度,商品房預(yù)告登記制度,商品房預(yù)售資金監(jiān)管制度等問題進(jìn)行剖析,從全局上詮釋中國商品房預(yù)售制度。第四章,以韓國商品房預(yù)售制度的角度出發(fā),闡述并分析韓國商品房預(yù)售的準(zhǔn)入條件、商品房交易申告制度、假登記制度、買賣擔(dān)保制度、商品房預(yù)售住宅請約等制度,為充分進(jìn)行中韓商品房預(yù)售制度對比研究進(jìn)行鋪墊。第五章,在中韓商品房預(yù)售制度全面分析的基礎(chǔ)上,對中韓兩國預(yù)售制度進(jìn)行分別比較與借鑒分析,并在此基礎(chǔ)上提出完善我國商品房預(yù)售制度的若干建議。第六章為結(jié)語,對本文寫作結(jié)論進(jìn)行最后闡述。
[Abstract]:Since it was formally used in our country in 1994, the system of pre-sale of commercial housing has become the main means of operation in the market of commercial housing in our country because it can lighten the burden of house buyers and solve the problems of running funds for the developers. It has made great contribution to the prosperity and development of the real estate industry in our country. However, at present, the laws and regulations of the pre-sale system of commercial housing in China are not perfect, lagged, and out of step with the development. For example, the regulation of pre-sale funds of commercial housing in our country is chaotic and there is no national standard, and so on, so we can not help asking how to effectively solve the defects brought about by the imperfect pre-sale system of commercial housing. In order to solve the problems existing in the practice of the pre-sale system of commercial housing in China, this paper tries to make a comparative analysis of the pre-sale system of commercial housing in China and South Korea. It is hoped that in the comparative analysis, the problems can be found and the experience can be used for reference to perfect the pre-sale system of commercial housing in China. In the introduction of the first chapter, this paper expounds the purpose and significance of the article, the present situation, the scope and methods of the research in an all-round way, in order to show the main purpose of this paper. The second chapter discusses the pre-sale system of commercial housing from the perspective of the outline of the pre-sale system of commercial housing, involving the concept of pre-sale of commercial housing, the characteristics and nature of pre-sale of commercial housing, as well as the emergence and development process of the pre-sale system of commercial housing. In advance from the overall grasp of commercial housing pre-sale system. The third chapter, taking the entry conditions of the pre-sale system of China's commercial housing as the entry point, analyzes the record keeping system of the pre-sale contract of China's commercial housing, the pre-registration system of the commercial housing, the supervision system of the funds for the pre-sale of the commercial housing, and so on.
