國(guó)外用法律維護(hù)歷史共識(shí)和民族英雄的司法實(shí)踐

【摘要】：法律是否可以用來(lái)維護(hù)國(guó)家和民族歷史共識(shí)以及民族英雄?世界上其他國(guó)家的司法實(shí)踐給我們提供了有益的借鑒:歐洲的大約15個(gè)國(guó)家包括比利時(shí)、荷蘭、瑞士、匈牙利、羅馬尼亞、西班牙等已經(jīng)在現(xiàn)行法律中明文規(guī)定,反對(duì)任何否認(rèn)和美化納粹歷史的行徑,德國(guó)更是身體力行,制定了有關(guān)的法律、法令和決議包括憲法、刑法、聯(lián)邦議會(huì)決議和教育法等;并且出現(xiàn)了不少經(jīng)典案例。包括美國(guó)、俄羅斯、韓國(guó)等多個(gè)國(guó)家通過(guò)了保護(hù)英雄名譽(yù)的立法。在中國(guó)最近的四次司法實(shí)踐中,人民法庭有效地將否定、質(zhì)疑、污蔑"狼牙山五壯士"的言論從一般意義上的"言論自由"中分割出來(lái),用法律手段維護(hù)了人民的基業(yè)不受傷害。中國(guó)以適當(dāng)?shù)�、�?yán)肅的方式立法維護(hù)全社會(huì)的歷史共識(shí)和民族英雄,這既是國(guó)家的合法權(quán)利,也是國(guó)家應(yīng)盡的義務(wù)和責(zé)任,是光明正大的、合法的,沒(méi)有什么輸理的地方。
[Abstract]:Can laws be used to maintain national and national historical consensus and national heroes? The judicial practice of other countries in the world has provided us with useful reference: about 15 countries in Europe, including Belgium, the Netherlands, Switzerland, Hungary, Romania, Spain and so on, have already stipulated in the existing laws. Against any denial and glorification of the Nazi history, Germany has enacted relevant laws, decrees and resolutions, including the Constitution, the Criminal Code, the resolutions of the Federal Parliament and the Education Act; And there are many classic cases. Several countries, including the United States, Russia and South Korea, have passed legislation to protect the reputation of heroes. In the last four judicial practices in China, the people's Court has effectively separated from the "freedom of speech" in the general sense of "freedom of speech" the statements of denying, questioning, and slandering the "five mighty men of Langya Mountain". The people's basic property was protected from harm by legal means. China legislates in an appropriate and serious manner to safeguard the historical consensus and national heroes of the whole society. This is not only the legitimate right of the state, but also the duty and responsibility of the state, and it is fair and square, legal, and there is nothing wrong with it.
