二元民主制與議會主權原則中的根本法

【摘要】：二元民主理論將政治過程劃分為憲法政治與日常政治,憲法政治就是由人民或人民的特別代表制定或修改憲法的高級立法程序。但是,二元民主的一些倡導者認為,英國的議會主權模式是一種相反的"一元民主"模式,不存在憲法政治與日常政治的區(qū)分。這種理解削弱了英國不成文憲法的意義、削弱了英國憲制的立憲主義因素。在英國政治史和思想史的共同考察下,光榮革命構成了英國歷史上的"憲法政治"時刻,英國議會主權思想與實踐中也蘊含相應的根本法觀念。二元民主與制憲權的概念以獨特的方式存在于英國議會主權理論與實踐中。
[Abstract]:The theory of dualistic democracy divides the political process into constitutional politics and daily politics. Constitutional politics is a high-level legislative procedure that is formulated or modified by the people or their special representatives. However, some advocates of dualistic democracy believe that the British parliamentary sovereignty model is an opposite "monistic democracy" model, and there is no distinction between constitutional politics and daily politics. This understanding weakens the meaning of Britain's unwritten constitution and weakens its constitutional constitutionalism. Under the joint investigation of British political history and ideological history, the glorious revolution constitutes the moment of "constitutional politics" in British history, and the idea of fundamental law is also contained in the thought and practice of British Parliament sovereignty. The concept of dual democracy and constitutional right exists in the theory and practice of British Parliament sovereignty in a unique way.
