【摘要】：法律與道德一直是法學(xué)研究的核心問題之一,"電車難題"作為其中一樁著名的虛擬案例引發(fā)了公眾與學(xué)界的廣泛關(guān)注。針對該案存在三種不同觀點,分別是瓊斯女士殺一救五做法有罪,無罪以及在軌道上的六人都應(yīng)受到懲罰,每種觀點背后皆有各自的法律和道德理據(jù)支撐。一方面不應(yīng)用簡單的功利主義原則來解決道德難題,同時也不應(yīng)簡單地否定功利主義原則的合理性及其在現(xiàn)實生活中的積極作用。從對"電車難題"的探討可以加深對法律與道德關(guān)系的認識與理解,進而為道德難題中法律的決疑提供有益的思路。
[Abstract]:Law and morality have always been one of the core problems in the study of law. As a famous virtual case, the tram puzzle has aroused wide public and academic attention. There are three different views on the case: Ms Jones is guilty of killing one man and five people are innocent and all six on the track should be punished, each with its own legal and moral justification. On the one hand, simple utilitarian principles should not be used to solve moral problems, and on the other hand, the rationality of utilitarianism principle and its positive role in real life should not be simply denied. The discussion of "tram puzzle" can deepen the understanding and understanding of the relationship between law and morality, and then provide a useful way of thinking for the determination of law in moral problems.
