守法激勵(lì)的經(jīng)濟(jì)分析

【摘要】:自覺(jué)守法是實(shí)現(xiàn)法治社會(huì)健康有序發(fā)展的基石,守法激勵(lì)的目的在于調(diào)動(dòng)公民的守法積極性。本文運(yùn)用法經(jīng)濟(jì)學(xué)范式,分析行為人運(yùn)用理性來(lái)選擇是否守法的過(guò)程,衡量計(jì)算守法成本與違法成本。探討幾種可能的守法激勵(lì)模式,排除干擾人們作出守法決策的外部因素,降低守法成本,從不同的角度來(lái)促進(jìn)公民守法,優(yōu)化法治結(jié)構(gòu)。
[Abstract]:Consciously abiding by the law is the cornerstone of the healthy and orderly development of the society ruled by law, and the purpose of law-abiding motivation is to arouse citizens' enthusiasm for abiding by the law. Using the paradigm of law and economics, this paper analyzes the process of choosing whether to abide by the law by means of rationality, and measures the cost of law-abiding and illegal. This paper discusses several possible incentive modes of law-abiding, removes the external factors that interfere people to make law-abiding decisions, reduces the cost of law-abiding, promotes citizens to abide by the law from different angles, and optimizes the structure of ruling by law.
