【摘要】：正編者按:權(quán)利可視為劃定行為界限、構(gòu)建倫理法律制度、解釋歷史發(fā)展的一種方法,而權(quán)利的概念化、體系化、制度化以及社會(huì)后果,又依賴(lài)邏輯學(xué)、倫理學(xué)、社會(huì)學(xué)、心理學(xué)、經(jīng)濟(jì)學(xué)、法學(xué)等不同知識(shí)體系的方法予以闡釋或論證、描述或分析。20世紀(jì)90年代,繼權(quán)利本位、人權(quán)理想、法治國(guó)家的討論后,學(xué)者們宣布中國(guó)"開(kāi)始邁入權(quán)利時(shí)代"。權(quán)利時(shí)代,既要實(shí)現(xiàn)在橫向關(guān)系上的權(quán)利界定及其救濟(jì),更要完成權(quán)利方法對(duì)權(quán)力機(jī)制的塑造,讓權(quán)力實(shí)踐除受制于自身邏輯外還受制于權(quán)利關(guān)系,即要將權(quán)利作為達(dá)成整個(gè)社會(huì)秩序的核心方法。這當(dāng)然離不開(kāi)權(quán)利形成、配置、實(shí)踐、反饋的具體方法的繁榮。為此,本刊第三屆青年公法論壇(2013年10月12—13日)以"作為方法的權(quán)利和權(quán)利的方法 "為題。
[Abstract]:The positive editor's note: rights can be seen as a way to delineate the boundaries of behavior, to construct an ethical legal system, to explain historical development, and to conceptualize, systematize, institutionalize, and social consequences of rights, and rely on logic, ethics, sociology, The methods of different knowledge systems such as psychology, economics, law and so on explain or prove, describe or analyze. After the discussion of the right standard, the human rights ideal and the country ruled by law in the 1990s, the scholars declare that China "begins to enter the era of right". In the era of rights, it is not only necessary to realize the definition and relief of the right in the horizontal relationship, but also to complete the shaping of the power mechanism by the right method, so that the practice of power is subject to not only its own logic, but also the relationship of rights. That is to say, right as the core method to achieve the whole social order. This is of course inseparable from the right formation, allocation, practice, feedback of the specific methods of prosperity. To this end, the third Youth Public Law Forum (12-13 October 2013) was entitled "Rights and methods as a method".
