【摘要】：哈貝馬斯(J.Habermas)的程序主義法正當(dāng)性理論代表著當(dāng)代法哲學(xué)與法社會(huì)學(xué)理論中針對(duì)法正當(dāng)性這一古典問題的嶄新嘗試,它具有客觀的社會(huì)學(xué)背景和內(nèi)在的認(rèn)識(shí)論基礎(chǔ)。首先,該理論產(chǎn)生于后形而上學(xué)的多元社會(huì),它因應(yīng)著政治系統(tǒng)合法化的認(rèn)同危機(jī)對(duì)法律系統(tǒng)所提出的時(shí)代要求。其次,該理論體現(xiàn)了當(dāng)代法哲學(xué)在實(shí)踐理性與實(shí)踐哲學(xué)的語(yǔ)境中對(duì)"真理符合論"的反思,在認(rèn)識(shí)論上具有深層的現(xiàn)象學(xué)基礎(chǔ)。近年來的研究表明,即使是在距離德國(guó)本土萬里之遙的中國(guó),哈貝馬斯的法哲學(xué)與法社會(huì)學(xué)思想也早已占據(jù)了頗為可觀的理論陣地,或可以為,以上兩點(diǎn)乃是對(duì)這門顯學(xué)本身展開詮釋或批判的前提性認(rèn)識(shí)。
[Abstract]:J. Habermas' legal legitimacy theory of procedure represents a new attempt in contemporary legal philosophy and sociology of law to deal with the classical issue of legitimacy of law. It has an objective sociological background and an inherent epistemological basis. First of all, the theory originated from the pluralistic society of post-metaphysics, and it is required by the legal system according to the recognition crisis of legalization of the political system. Secondly, the theory reflects the reflection of the theory of truth conformity in the context of practical rationality and practical philosophy, and has a deep phenomenological foundation in epistemology. Studies in recent years have shown that even in China, a distance from Germany, Habermas's philosophy of law and sociology of law have already occupied a considerable theoretical position. The above two points are the presupposition of the interpretation or criticism of this school of expression.
