【摘要】：正國內(nèi)外學(xué)者對田會多有誤解,將之歸為神會或慈善組織一類,并將田會的財產(chǎn)——會田,歸為廟產(chǎn)或嘗產(chǎn)(祀田)。究其原因,乃是對文獻(xiàn)的誤讀,即視會田買賣契約為賣契。其實,會田買賣契約是抵押合同的變種,不是真正意義上的賣契。我們發(fā)現(xiàn),會田買賣契約常常有兩份同樣內(nèi)容的賣契,一份稱永賣契,一份叫找絕契。其緣由要從清代的法律制度上去理解。"典當(dāng)田畝,例準(zhǔn)贖回。""若賣主無力贖回,許憑中公估找貼一次,另立絕賣契紙。若賣主不愿找貼,聽其別賣,歸還原價。"(《欽定大清會典事例》卷一六0,《戶部·田賦》)清代法律規(guī)定,不允許抵押物在借款人到期違約時自動歸抵押權(quán)
[Abstract]:Scholars at home and abroad often misunderstand Tian Hui, classifying it as a kind of divine or charitable organization, and classifying the property of Tian Hui Tian as a temple property or a temple property. The reason is the misreading of the literature, that is to say, the contract of sale of Hui Tian is a lease of sale. In fact, the contract of purchase and sale of Hui Tian is a variant of the mortgage contract, not the real contract of sale. We have found that there are often two leases of sale in Huitian, one is a permanent lease, the other is an absolute lease. The reason should be understood from the legal system of Qing Dynasty.
