由“習慣法”到“習慣立法”——以“祭祀公業(yè)”與“合會”為線索

【摘要】:民法典編纂需要正視習慣立法問題,以習慣法作為相應規(guī)范設計的參考依據(jù)。我國臺灣地區(qū)對祭祀公業(yè)和合會習慣立法的經(jīng)驗可資參考。祭祀公業(yè)和合會習慣自身存在的問題,催生了對于兩者的立法。我國臺灣地區(qū)通過制定特別條例的方式,完成了對祭祀公業(yè)的立法。而對合會的立法,則由其"民法"債編修訂直接完成。但是,兩者立法也引發(fā)了進一步的問題。民法典各分編編纂應慎重對待既存習慣法,習慣立法應尊重人民對于相關習慣法的法的確信,開展一定的習慣調(diào)查。
[Abstract]:The compilation of civil code needs to face up to the problem of customary legislation and take customary law as the reference for the design of relevant norms. The experience of the customary legislation of sacrifice to public property and society in Taiwan area can be used for reference. The problem of sacrificing the public karma and the society itself gave birth to the legislation of the two. In Taiwan, the legislation on sacrificial public works was completed by making special regulations. And the legislation of the society is directly completed by the debt compilation and revision of its Civil Code. However, the two legislation also raises further problems. In the compilation of the Civil Code, the existing customary law should be treated with caution, and the customary legislation should respect the people's conviction of the relevant customary law and carry out a certain customary investigation.
