【摘要】：國(guó)外對(duì)習(xí)慣法的研究比較早,成果也比較深厚,這些成果對(duì)國(guó)內(nèi)習(xí)慣法的研究產(chǎn)生了深遠(yuǎn)的影響。我國(guó)從20世紀(jì)90年代開(kāi)始,對(duì)習(xí)慣法進(jìn)行了比較系統(tǒng)地研究。目前為止,習(xí)慣法的研究已經(jīng)成為我國(guó)法學(xué)界日漸重要的領(lǐng)域,甚至一度成為研究的熱點(diǎn)。本文首先對(duì)國(guó)內(nèi)外習(xí)慣法界定的研究進(jìn)行綜述,接著對(duì)國(guó)內(nèi)外習(xí)慣法界定問(wèn)題的研究焦點(diǎn)進(jìn)行討論,最后嘗試對(duì)習(xí)慣法進(jìn)行初步的界定。
[Abstract]:The foreign research on customary law is earlier and the results are more profound. These results have a profound influence on the study of domestic customary law. Since 1990's, our country has carried on the relatively systematic research to the customary law. So far, the study of customary law has become an increasingly important field in the field of law in China. This paper first summarizes the research on the definition of customary law at home and abroad, then discusses the focus of the study on the definition of customary law at home and abroad, and finally attempts to make a preliminary definition of customary law.
