【摘要】：糾紛是社會學(xué)概念,法律糾紛是法學(xué)概念,矛盾、爭執(zhí)、爭議和沖突是與糾紛相關(guān)的概念。這些概念都用來描述權(quán)利義務(wù)失衡這樣一種社會現(xiàn)象;但是,描述的狀態(tài)和劇烈程度不同,矛盾描述處于內(nèi)隱狀態(tài)的社會現(xiàn)象,爭執(zhí)、爭議、糾紛和沖突描述處于外顯狀態(tài)的社會現(xiàn)象;矛盾的劇烈程度最弱,沖突的劇烈程度最強(qiáng),糾紛處于從爭執(zhí)、爭議向沖突的過度階段。
[Abstract]:Disputes are sociological concepts, legal disputes are legal concepts, contradictions, disputes, disputes and conflicts are related to disputes. These concepts are used to describe a social phenomenon, such as the imbalance of rights and obligations; however, the state and intensity of the description are different, and contradictions describe social phenomena, disputes and disputes in an implicit state. Dispute and conflict describe the social phenomenon in explicit state; the intensity of contradiction is the weakest, the intensity of conflict is the strongest, and the dispute is in the transitional stage from dispute to conflict.
