【摘要】：隨著我國反壟斷處罰爭議的逐漸顯現(xiàn),有關(guān)反壟斷罰款決定的司法審查問題迫切需要關(guān)注。依據(jù)我國現(xiàn)行立法,法院有權(quán)對明顯不當(dāng)?shù)姆磯艛嗔P款決定予以撤銷或變更,但相關(guān)審查標(biāo)準(zhǔn)和強(qiáng)度并不明確�；跉W盟對我國反壟斷法的體系性影響和我國對大陸法系行政法傳統(tǒng)的因襲相承,其經(jīng)驗(yàn)可資借鑒。制度上,歐盟法院對反壟斷罰款決定享有不受限制的審查權(quán),可以取消、減少或增加罰款數(shù)額。實(shí)踐中,法院對這一權(quán)力的行使經(jīng)歷了強(qiáng)力審查—相對寬松—再度收緊的大體趨勢。我國應(yīng)嚴(yán)格審查反壟斷罰款決定,同時(shí)當(dāng)涉及確定罰款的相關(guān)指南時(shí),法院應(yīng)在確認(rèn)指南合法性的基礎(chǔ)上審查罰款決定對指南的適用是否合法,但在有正當(dāng)理由的情形下,法院也可在個(gè)案中對指南有所偏離。
[Abstract]:With the emergence of disputes on antitrust penalty in China, the judicial review of antitrust penalty decision needs to be paid more and more attention. According to the current legislation of our country, the court has the power to revoke or change the obviously improper decision of antitrust penalty, but the relevant standards and intensity of examination are not clear. Based on the systematic influence of EU on China's antimonopoly law and the inheritance of administrative law tradition in civil law system, its experience can be used for reference. Institutionally, EU courts have unlimited review of antitrust fines, and may cancel, reduce or increase the amount of fines. In practice, the court's exercise of this power has undergone a general trend of intense-relatively lenient-retightening. China should strictly review the decision on antitrust fines, and when it comes to the relevant guidelines for the determination of fines, the courts shall, on the basis of confirming the legality of the guidelines, examine whether the application of the decision to the guidelines is lawful, but in cases where there are valid reasons, Courts may also deviate from the guidelines in individual cases.
