【摘要】：地方性法規(guī)的清理是有立法權(quán)的地方人大及其常委會(huì)依據(jù)一定的標(biāo)準(zhǔn),對(duì)一定時(shí)期或范圍內(nèi)由其制定的地方性法規(guī)進(jìn)行集中的審查,并確定法規(guī)的效力及變動(dòng)情況的活動(dòng)。從宏觀層面分析,地方性法規(guī)清理具有提高立法質(zhì)量的功能;從微觀層面分析,地方性法規(guī)清理具有維護(hù)法制統(tǒng)一、審視法規(guī)有效性和“檢驗(yàn)”法規(guī)質(zhì)量的功能。 在法律和部分地方性法規(guī)中,可見關(guān)于地方性法規(guī)清理的規(guī)定,涉及啟動(dòng)主體、實(shí)施主體、清理標(biāo)準(zhǔn)和清理的頻度。通過對(duì)地方性法規(guī)清理的實(shí)踐的實(shí)證分析發(fā)現(xiàn),當(dāng)前的運(yùn)動(dòng)式集中清理模式在程序和實(shí)體上都存在一定的不足,法規(guī)清理制度尚未發(fā)揮應(yīng)有的功能。 為此,有必要引入常態(tài)化的地方性法規(guī)清理機(jī)制,拓寬法規(guī)清理的啟動(dòng)主體的范圍,完善啟動(dòng)程序,確定常規(guī)法規(guī)清理的時(shí)間間隔,細(xì)化梳理程序和處理程序。梳理法規(guī)應(yīng)當(dāng)由人大相關(guān)機(jī)構(gòu)進(jìn)行,同時(shí)征求其他主體對(duì)法規(guī)的清理意見或建議;對(duì)法規(guī)做出處理應(yīng)當(dāng)視情況由人大和人大常委會(huì)共同承擔(dān)。
[Abstract]:The clean-up of local laws and regulations is the activity of the local people's congresses and their standing committees with legislative power to conduct a centralized examination of the local laws and regulations formulated by them in a certain period or scope according to certain standards and to determine the validity and changes of the laws and regulations. From the macro level, the cleaning up of local laws and regulations has the function of improving the quality of legislation, and from the micro level, it has the function of maintaining the unity of legal system, examining the validity of laws and regulations and "checking" the quality of laws and regulations. In laws and some local laws and regulations, we can see the regulations on cleaning local laws and regulations, which involve starting subject, implementing subject, cleaning standard and cleaning frequency. Through the empirical analysis of the practice of local law cleaning, it is found that the current mode of centralized cleaning of local laws and regulations has some shortcomings in both procedure and entity, and the system of law cleaning has not yet played its due function. Therefore, it is necessary to introduce the regular local law cleaning mechanism, widen the scope of the starting subject, perfect the starting procedure, determine the time interval of the regular law cleaning, and refine the sorting program and processing procedure. Combing laws and regulations shall be carried out by the relevant organs of the people's Congress and other subjects shall be solicited for their views or suggestions on the clean-up of the laws and regulations.
