【摘要】：律師制度對于如今的人們早已不是一個陌生的詞匯,而是已經(jīng)隨著法治的發(fā)展深入我們的生活。同時也隨著法治的健全完善走進人們的生活,人們也越來越習慣于用專業(yè)的法律人才來——律師來保障自己的權(quán)益。所以,了解和完善律師制度對于人們的生活有重要的意義。日本是律師制度相對比較發(fā)達的國家之一,研究日本的律師制度對我國律師乃至司法制度的發(fā)展都有借鑒的作用。律師制度是國家關(guān)于律師性質(zhì)、任務(wù)、權(quán)利和義務(wù)及律師活動原則、組織結(jié)構(gòu)、管理體制、法律責任、業(yè)務(wù)范圍等法律規(guī)范的總稱。[1]律師制度含有職業(yè)資格、權(quán)利義務(wù)的等多方面的問題,本文主要以律師資格的取得為切入點來研究律師制度的問題。
[Abstract]:The lawyer system is no longer a strange word for people today, but has developed into our lives with the development of the rule of law. At the same time, with the sound and perfect of the rule of law into people's lives, people are more and more used to use professional legal talents to protect their rights and interests. Therefore, understanding and perfecting the lawyer system is of great significance to people's life. Japan is one of the relatively developed countries of lawyer system. The study of Japanese lawyer system can be used for reference for the development of our lawyers and even the judicial system. The lawyer system is a general name of the national legal norms concerning the nature, tasks, rights and obligations of lawyers, principles of lawyers' activities, organizational structure, management system, legal responsibility, scope of business, etc. [1] the lawyer system contains professional qualifications, Rights and obligations, and so on, this article mainly to obtain the lawyer qualification as a starting point to study the lawyer system.
