【摘要】：本文通過回顧法權(quán)概念、法權(quán)理論的研究方法和范疇體系,研究法權(quán)關(guān)系自身的結(jié)構(gòu)及其效力范圍,運(yùn)用法權(quán)的指引功能去分析當(dāng)前我國城管執(zhí)法問題,并將其作為一個法權(quán)問題進(jìn)行論述,重點剖析了這一法權(quán)關(guān)系中的權(quán)力和權(quán)利的錯配和優(yōu)化問題,深化了對這一問題的法權(quán)認(rèn)識,有助于借助法權(quán)理論去探析存在的問題,增強(qiáng)法權(quán)問題意識,構(gòu)建和諧的城管執(zhí)法秩序。
[Abstract]:By reviewing the concept of legal right, the research methods and category system of the theory of legal right, the structure and scope of the legal power relationship itself, this paper uses the guiding function of the legal right to analyze the current law enforcement problems of urban management in China. It is discussed as a problem of legal right, and the mismatch and optimization of power and right in the relationship of legal right are analyzed emphatically, and the understanding of the right of law is deepened, which is helpful to analyze the existing problems with the aid of the theory of right of law. Strengthen the awareness of legal rights, and build a harmonious law enforcement order of urban management.
