【摘要】：近年來(lái)，隨著網(wǎng)絡(luò)輿論的壯大和網(wǎng)絡(luò)媒體的不斷發(fā)展，網(wǎng)絡(luò)輿情覆蓋面不斷擴(kuò)大，對(duì)公正執(zhí)法的影響力日趨擴(kuò)張。網(wǎng)絡(luò)輿情在主體、客體、載體、本體方面的特征與執(zhí)法活動(dòng)的主體、客體及職能特征相互碰撞，二者之間的主體差異性、內(nèi)容關(guān)聯(lián)性、職能耦合性等關(guān)系，為網(wǎng)絡(luò)輿情與公正執(zhí)法之間互動(dòng)的可能性提供了現(xiàn)實(shí)基礎(chǔ)。頻繁發(fā)生的“開(kāi)胸驗(yàn)肺”、“釣魚執(zhí)法”、“周老虎”、“天價(jià)煙”、“微博打拐”等涉及執(zhí)法的公共輿情事件，一方面彰顯出網(wǎng)絡(luò)輿情對(duì)公正執(zhí)法的推動(dòng)作用，不但有利于揭露我國(guó)執(zhí)法過(guò)程中存在的問(wèn)題，監(jiān)督執(zhí)法活動(dòng)，而且為執(zhí)法活動(dòng)提供了網(wǎng)絡(luò)反腐、網(wǎng)絡(luò)問(wèn)政等適應(yīng)社會(huì)發(fā)展的新型執(zhí)法思路，創(chuàng)新執(zhí)法形式；另一方面，網(wǎng)絡(luò)輿情現(xiàn)象中的人肉搜索、網(wǎng)絡(luò)調(diào)查等行為也存在破壞網(wǎng)絡(luò)法治環(huán)境的負(fù)面影響。隨著網(wǎng)絡(luò)輿情影響力不斷增強(qiáng)，輿情對(duì)“媒治”的呼聲漸高。通過(guò)對(duì)網(wǎng)絡(luò)輿情現(xiàn)象的深層剖析，推知網(wǎng)絡(luò)輿情作為一種社會(huì)監(jiān)督力量，依然是法治不可或缺的構(gòu)成性機(jī)制，，但其“媒治”效應(yīng)只是權(quán)利對(duì)權(quán)力行使監(jiān)督作用的彰顯。網(wǎng)絡(luò)輿情現(xiàn)象體現(xiàn)出社會(huì)公眾對(duì)于自由、平等、公正的深切渴望，凸顯了社會(huì)對(duì)法治的深度訴求，為網(wǎng)絡(luò)輿情與公正執(zhí)法之間互動(dòng)的必要性提供了現(xiàn)實(shí)依據(jù)。網(wǎng)絡(luò)輿情與公正執(zhí)法作為法律運(yùn)行的重要環(huán)節(jié)，在處理二者關(guān)系時(shí)，要堅(jiān)持立足法治，嚴(yán)格規(guī)范執(zhí)法，完善法律監(jiān)督體系，推進(jìn)公正執(zhí)法實(shí)效；利用網(wǎng)絡(luò)推進(jìn)信息公開(kāi)制度，化“媒治”力量為法治所用，保障執(zhí)法透明；建立網(wǎng)絡(luò)輿情應(yīng)對(duì)機(jī)制，以制度消解網(wǎng)絡(luò)輿情的負(fù)面影響，推進(jìn)新媒體時(shí)代法治化建設(shè)，促成法治社會(huì)的良性運(yùn)轉(zhuǎn)。
[Abstract]:In recent years, with the expansion of network public opinion and the continuous development of network media, the coverage of network public opinion is expanding, and the influence on fair law enforcement is expanding day by day. The characteristics of network public opinion in the aspects of subject, object, carrier and ontology collide with the subject, object and function characteristics of law enforcement activities. It provides a realistic basis for the possibility of interaction between network public opinion and impartial law enforcement. The frequent public opinion incidents involving "chest examination", "fishing enforcement", "Zhou tiger", "sky-high smoke", "Weibo trafficking" and so on, on the one hand, highlight the role of network public opinion in promoting fair law enforcement. It is not only conducive to exposing the problems existing in the course of law enforcement in our country and supervising law enforcement activities, but also providing new law enforcement ideas and innovative forms of law enforcement that are adapted to the development of society, such as network anti-corruption, network administration, and so on; on the other hand, The human flesh search and network investigation in the phenomenon of network public opinion also have the negative influence to destroy the environment of network rule of law. With the increasing influence of network public opinion, the voice of public opinion to "media governance" is increasing. Through the deep analysis of the phenomenon of network public opinion, it is inferred that network public opinion, as a kind of social supervision power, is still an indispensable constitutive mechanism of the rule of law, but its "medium governance" effect is only the manifestation of the right's supervisory function on the exercise of power. The phenomenon of network public opinion reflects the deep desire of the public for freedom, equality and justice, highlights the deep demand of society for the rule of law, and provides a realistic basis for the necessity of interaction between network public opinion and impartial law enforcement. Network public opinion and impartial law enforcement are important links in the operation of law. When dealing with the relationship between them, we should stick to the rule of law, strictly standardize law enforcement, perfect the legal supervision system, promote the effectiveness of fair law enforcement, and use the network to promote the information disclosure system. The power of "media governance" is used for the rule of law to ensure the transparency of law enforcement, to establish a mechanism to deal with network public opinion, to eliminate the negative influence of network public opinion by system, to promote the construction of the rule of law in the new media era, and to promote the benign operation of the society ruled by law.
