【摘要】：范應(yīng)鈴是南宋一位深明法理又不失人情的判官。他長(zhǎng)期在地方任職,深知民間疾苦,同時(shí)他深受儒學(xué)思想的熏陶,儒家倫理綱常的觀念對(duì)他影響極深,故他在判案過(guò)程中特別注重法、理與情3者的結(jié)合。在《名公書(shū)判清明集》中,范應(yīng)鈴的判詞直觀反映了他重視法理、人情和同情弱者的法律思想。
[Abstract]:Fan Ying-ling was a judge of the Southern Song Dynasty. He worked in the local place for a long time, knew well the folk pain, at the same time he was deeply influenced by Confucianism thought, the Confucian ethics principle idea had a very deep influence on him, so he paid special attention to the combination of law, reason and emotion in the process of adjudicating a case. In the judgment of Ming and Ming Dynasty, Fan Ying-ling 's judgment intuitively reflects his legal thought of attaching importance to jurisprudence, human feelings and sympathy for the weak.
