地方立法監(jiān)督程序的體系完善

【摘要】:立法監(jiān)督是我國依法治國、完善立法的一種重要手段和措施,它的存在是在于保障立法的公平、正義,避免和預(yù)防立法權(quán)濫用或立法權(quán)閑置的問題出現(xiàn),維護(hù)立法的權(quán)益、促進(jìn)立法水平、提高立法質(zhì)量。但現(xiàn)實(shí)情況中法律規(guī)定的稀少與缺失,使立法監(jiān)督特別是地方立法監(jiān)督程序的實(shí)施缺少可參照的依據(jù),影響了立法監(jiān)督的有效實(shí)施。本文在對我國目前的立法監(jiān)督程序情況及完善立法監(jiān)督程序的重要性進(jìn)行介紹后,對學(xué)界關(guān)于立法監(jiān)督的三種不同分類進(jìn)行了詳細(xì)論述,并就其中關(guān)于立法監(jiān)督程序結(jié)構(gòu)設(shè)計的分類加以詳述,論述該結(jié)構(gòu)體系中可能存在的缺點(diǎn)與不足并提出自己的改進(jìn)觀點(diǎn)。 地方立法監(jiān)督的啟動程序是立法監(jiān)督的開端,它開啟了立法監(jiān)督的序幕,為立法監(jiān)督的開始提供了依據(jù)和參考。地方立法監(jiān)督啟動需要一定的主體,依照我國相關(guān)法律、法規(guī)規(guī)定及法理原理,文章討論出能夠的啟動立法監(jiān)督的主體較為廣泛。有主體就要有相應(yīng)的監(jiān)督對象,在我國地方立法各具特色,因此立法監(jiān)督的對象也是種類繁多、形式各異。任何權(quán)利的行使都是應(yīng)當(dāng)受到一定限制與設(shè)定的,立法監(jiān)督權(quán)也如此,立法監(jiān)督主體的監(jiān)管范圍也應(yīng)確定,不加限量會導(dǎo)致立法監(jiān)督權(quán)交叉混同,造成權(quán)利實(shí)現(xiàn)困難或是權(quán)利分配不均,出現(xiàn)權(quán)利使用不當(dāng)及濫用。立法監(jiān)督的行使還應(yīng)當(dāng)有時間的限定,而非可以任意進(jìn)行,針對不同監(jiān)督主體時有自身的時間設(shè)置,就同一種主體而言也要適用法律的相關(guān)規(guī)定。 地方立法監(jiān)督的實(shí)施程序是立法監(jiān)督的重要階段也是實(shí)質(zhì)進(jìn)行的過程,對立法的有效實(shí)現(xiàn)有著致關(guān)重要的作用。此階段的立法監(jiān)督程序主要涉及對立法內(nèi)容的合法性、合理性審查,合法性是立法的基礎(chǔ),只有在法定權(quán)限之內(nèi)所立之法,不存在矛盾抵觸情況,才能使訂立的法律、法規(guī)得以實(shí)施。實(shí)施地方立法監(jiān)督的方式和手段主要包括批準(zhǔn)、備案、審查和清理,并以撤銷權(quán)為保障措施,有效保證立法監(jiān)督的真正實(shí)現(xiàn)。立法監(jiān)督的行使不應(yīng)盲目而無節(jié)制,它的實(shí)施過程中要有一定的期限限制,在設(shè)立的時限中得出相關(guān)的監(jiān)督結(jié)論為下一步的立法監(jiān)督結(jié)果付出實(shí)踐提供依據(jù)和支持。 地方立法監(jiān)督的執(zhí)行程序是對立法監(jiān)督實(shí)施過后得出結(jié)論的貫徹落實(shí),是反映立法監(jiān)督實(shí)效的重要程序,也起到了對立法監(jiān)督結(jié)果考察糾偏的作用。執(zhí)行立法監(jiān)督的結(jié)論,需要有主體來實(shí)現(xiàn)。執(zhí)行是要將立法監(jiān)督主體得出結(jié)論加以落實(shí),依照我國的法律、法規(guī)及有關(guān)地方法規(guī)的規(guī)定,執(zhí)行主體利用批準(zhǔn)通過、法定撤銷或改變、有權(quán)審查、清理舊法的方法來落實(shí)立法監(jiān)督的結(jié)果。監(jiān)督結(jié)論的執(zhí)行中有權(quán)利自然就要承擔(dān)應(yīng)有的責(zé)任,實(shí)現(xiàn)權(quán)利責(zé)任的對等,也是對行使立法監(jiān)督的一種限制與再監(jiān)督。有了責(zé)任,就有救濟(jì)措施,這樣才能真正保證立法監(jiān)督結(jié)論的實(shí)現(xiàn)與執(zhí)行。 啟動、實(shí)施、執(zhí)行三者相互配合、相輔相成,組成一個完整、連貫的立法監(jiān)督的程序體系,為立法監(jiān)督的實(shí)施提供了程序保障,用程序來支持和維護(hù)實(shí)體的進(jìn)程,更好地實(shí)現(xiàn)我國地方立法監(jiān)督的發(fā)展。
[Abstract]:Legislative supervision is an important means and measure to govern the country according to law and improve the legislation. Its existence is to guarantee the fairness and justice of legislation, to avoid and prevent the abuse of the legislative power or the idle of the legislative power, to safeguard the rights and interests of the legislation, to promote the legislative level and to improve the quality of the legislation. The implementation of legislative supervision, especially the implementation of local legislative supervision procedures, is short of reference, which affects the effective implementation of legislative supervision. After introducing the current legislative supervision procedures and the importance of perfecting the legislative supervision procedures, this paper expounds the three different categories of legislative supervision in the academic circles. In this paper, the classification of the structural design of the legislative supervision procedure is described in detail, and the shortcomings and shortcomings that may exist in the structural system are discussed and their own improvement views are put forward.

The exercise of legislative supervision should also be limited by time, but not to be carried out arbitrarily. In the case of different supervisory subjects, there should be their own time setting, and the relevant provisions of the law should also be applied to the same subject.
The implementation procedure of the local legislative supervision is an important stage of the legislative supervision and the substantive process, which plays an important role in the effective realization of the legislation. The legislative supervision procedure at this stage mainly involves the legality of the legislative content, the rationality examination, the legitimacy as the basis of the legislation, and the law which is established within the legal authority, There is no contradiction between conflict and conflict in order to make the laws and regulations put into practice. The ways and means to implement the supervision of local legislation include approval, filing, examination and cleaning, and the real realization of the legislative supervision with the right of revocation as the guarantee.
