中日不動(dòng)產(chǎn)登記制度比較研究

【摘要】:不動(dòng)產(chǎn),作為一個(gè)國(guó)家和社會(huì)最重要的財(cái)產(chǎn)之一,是一個(gè)國(guó)家或民族生存發(fā)展的基礎(chǔ)資源。不動(dòng)產(chǎn)登記制度不僅是保護(hù)不動(dòng)產(chǎn)交易安全、提高交易效率的重要制度基礎(chǔ),同時(shí)保障了國(guó)家對(duì)不動(dòng)產(chǎn)的有效監(jiān)督和調(diào)控,因此是一項(xiàng)極其重要的制度。無(wú)論是英美法系國(guó)家亦或是大陸法系國(guó)家,都十分重視不動(dòng)產(chǎn)登記制度的完善,而且許多國(guó)家已經(jīng)頒布了符合本國(guó)實(shí)際且便于科學(xué)操作的不動(dòng)產(chǎn)登記法律法規(guī)。隨著《物權(quán)法》的出臺(tái),我國(guó)不動(dòng)產(chǎn)登記制度也逐步向完善、統(tǒng)一的方向快速發(fā)展,但由于《物權(quán)法》中關(guān)于不動(dòng)產(chǎn)登記之規(guī)定僅是宏觀(guān)上的,因此在實(shí)踐運(yùn)用過(guò)程中仍因缺乏參考而處于比較混亂的狀態(tài)。與我國(guó)有著一衣帶水相鄰關(guān)系的日本,目前已經(jīng)形成了比較系統(tǒng)的不動(dòng)產(chǎn)登記制度。因此,本文希望通過(guò)將兩國(guó)不動(dòng)產(chǎn)登記制度的重要內(nèi)容進(jìn)行詳細(xì)對(duì)比分析,能夠?yàn)槲覈?guó)不動(dòng)產(chǎn)登記制度的完善提供借鑒資料。 文章論題為中日不動(dòng)產(chǎn)登記制度比較研究,全文共分五章: 第一章不動(dòng)產(chǎn)物權(quán)變動(dòng)及公示制度?傮w闡述了物權(quán)變動(dòng)的歷史流變、物權(quán)公示公信原則及物權(quán)變動(dòng)模式的選擇與發(fā)展。重點(diǎn)介紹我國(guó)和日本物權(quán)變動(dòng)相關(guān)制度的發(fā)展過(guò)程和特點(diǎn)。 第二章中日不動(dòng)產(chǎn)登記制度立法之比較。介紹了中日兩國(guó)不動(dòng)產(chǎn)登記模式的選擇、中日兩國(guó)對(duì)不動(dòng)產(chǎn)之界定和中日兩國(guó)房地關(guān)系制度及特點(diǎn)等與不動(dòng)產(chǎn)登記立法相關(guān)重要問(wèn)題,是探討和理解中日兩國(guó)不動(dòng)產(chǎn)登記制度具體差異的前提和基礎(chǔ)。 第三章是關(guān)于中日兩國(guó)不動(dòng)產(chǎn)登記類(lèi)型的比較,,通過(guò)對(duì)比分析兩國(guó)法律法規(guī)和學(xué)術(shù)理論,論證兩國(guó)不動(dòng)產(chǎn)登記類(lèi)型之具體規(guī)定與制度根源之間的聯(lián)系。 第四章是關(guān)于不動(dòng)產(chǎn)登記機(jī)關(guān)、登記簿等不動(dòng)產(chǎn)程序問(wèn)題的對(duì)比。該部分內(nèi)容采用列圖表等對(duì)比形式,更加形象展現(xiàn)兩國(guó)不動(dòng)產(chǎn)登記程序上之差異。 第五章闡述我國(guó)不動(dòng)產(chǎn)登記制度的現(xiàn)狀和完善建議。以我國(guó)《物權(quán)法》中涉及的不動(dòng)產(chǎn)登記相關(guān)規(guī)定為視角,通過(guò)中日對(duì)比的方法,客觀(guān)分析我國(guó)不動(dòng)產(chǎn)登記制度的成果與不足。并根據(jù)《物權(quán)法》對(duì)不動(dòng)產(chǎn)登記制度的綱領(lǐng)性規(guī)定,提出一些具體的完善建議。
[Abstract]:Real estate, as one of the most important property of a country and society, is the basic resource for the survival and development of a country or a nation. The real estate registration system is not only the important system foundation to protect the real estate transaction security and improve the transaction efficiency, but also ensures the effective supervision and control of the real estate by the state, so it is an extremely important system. Both Anglo-American law countries and civil law countries attach great importance to the perfection of real estate registration system, and many countries have promulgated laws and regulations of real estate registration which accord with their actual conditions and are convenient for scientific operation. With the introduction of the Real right Law, the registration system of real estate in our country has been developed rapidly in the direction of perfection and unification. However, the regulation on the registration of real estate in the Law of Real Rights is only macroscopic. Therefore, the process of practice is still in a more chaotic state because of lack of reference. Japan, which has a close relationship with our country, has formed a systematic real estate registration system. Therefore, this paper hopes to compare and analyze the important contents of the real estate registration system in the two countries in order to provide reference for the improvement of the real estate registration system in our country. The thesis is about the comparative study of the real estate registration system between China and Japan, which is divided into five chapters: Chapter one: real property right change and publicity system. This paper expounds the historical change of real right change, the principle of publicizing public credit of real right and the choice and development of real right change mode. This paper mainly introduces the development process and characteristics of the system of real right change in China and Japan. The second chapter compares the legislation of real estate registration system between China and Japan. This paper introduces the choice of real estate registration mode between China and Japan, the definition of real estate in China and Japan, and the system and characteristics of the relationship between China and Japan, and so on, which are related to the legislation of real estate registration. It is the premise and foundation of discussing and understanding the difference of real estate registration system between China and Japan. The third chapter is about the comparison of the types of real estate registration between China and Japan, through the comparative analysis of the laws and regulations of the two countries and academic theory, demonstrate the relationship between the specific provisions of the two countries' real estate registration type and the root of the system. The fourth chapter is about the real estate registration authority, registration book and other real estate procedures. In this part, the difference of real estate registration procedures between the two countries is shown more vividly in the form of tables and graphs. The fifth chapter elaborates the present situation and the perfect suggestion of the real estate registration system in our country. From the perspective of the relevant regulations of real estate registration in the Real right Law of our country, this paper analyzes objectively the achievements and shortcomings of the real estate registration system in China through the method of comparison between China and Japan. According to the programmatic regulation of real estate registration system, some concrete suggestions are put forward.
