【摘要】：作為近代中國(guó)"新法家"的重要代表,常燕生通過(guò)創(chuàng)立"生物史觀",發(fā)現(xiàn)中國(guó)的根本問(wèn)題在于建立一個(gè)近代國(guó)家。這是中國(guó)起死回生的唯一方案。而要實(shí)現(xiàn)中國(guó)的起死回生,就必須復(fù)興法家的思想,建立"新法家思想"。為此,常燕生重新估定法家的價(jià)值,認(rèn)為法家思想具有先進(jìn)性、功效性,并有助于推動(dòng)近代國(guó)家在中國(guó)的建設(shè)。雖然常燕生未能發(fā)展出系統(tǒng)性的"新法家思想",但他對(duì)近代中國(guó)的民主政治和法治問(wèn)題也進(jìn)行了一些獨(dú)到的思考與謀劃。常燕生開辟的"新法家"之路,值得我們關(guān)注和反思。
[Abstract]:As an important representative of the "new legalists" in modern China, Chang Yansheng found that the fundamental problem of China lies in the establishment of a modern country through the creation of the "concept of Biological History". This is the only way for China to recover from death. In order to realize the revival of China, it is necessary to revive the thought of Legalists and establish the thought of New Legalists. For this reason, Chang Yansheng revalued the value of Legalists, and thought that the thought of Legalism was advanced, effective and helpful to the construction of modern country in China. Although Chang Yansheng failed to develop a systematic "new legalist thought", he also made some original thoughts and plans on the democratic politics and the rule of law in modern China. Chang Yansheng opened up the road of "new legalists", which is worthy of our attention and reflection.
