【摘要】：安樂死是人類社會把目光投向了“死”、“優(yōu)死”的產(chǎn)物,全世界對此的爭論此起彼伏。安樂死在國外少數(shù)幾個國家和地區(qū)得到承認,其理念傳入我國后在法學(xué)界、倫理學(xué)界、社會學(xué)界等都掀起一場激烈的討論,對安樂死立法的呼聲日益高漲,但目前我國法律對此仍持有保守態(tài)度。關(guān)于對安樂死合法化的研究,筆者從安樂死具體案例展開分析,以安樂死事實為切入點,闡述安樂死的概念,對比介紹國外與國內(nèi)的安樂死立法現(xiàn)狀及各種法律困擾,以安樂死與故意殺人的區(qū)別為前提,著重論述安樂死在我國刑法學(xué)界與犯罪的各種爭論緣由,從大陸法系的外國刑法理論來探討安樂死非犯罪化的法律依據(jù),并圍繞著病理基礎(chǔ)、倫理基礎(chǔ)、人權(quán)基礎(chǔ)及我國現(xiàn)有國情展開理論綜述,說明我國具有安樂死合法化的合理性和可以在局部范圍進行立法試點的可行性,并嘗試著討論安樂死立法的種種細節(jié)問題,對安樂死提出若干嚴格限制,旨在積極地規(guī)范和保護安樂死。
[Abstract]:Euthanasia is the product of "death" and "excellent death". Euthanasia has been recognized in a few foreign countries and regions. After its concept was introduced into our country, there was a heated discussion in the legal, ethical and social circles, and the voice of euthanasia legislation was rising day by day. But at present our country law still holds the conservative attitude to this. On the research of legalization of euthanasia, the author analyzes the specific cases of euthanasia, expounds the concept of euthanasia from the point of view of the fact of euthanasia, and compares the current situation of euthanasia legislation in foreign and domestic countries and various kinds of legal troubles. On the premise of the difference between euthanasia and intentional homicide, this paper focuses on the reasons for the controversy between euthanasia and crime in the field of criminal law of our country, and probes into the legal basis of decriminalization of euthanasia from the foreign criminal law theory of continental law system. And around the pathology foundation, the ethics foundation, the human rights foundation and the present situation of our country, the theoretical summary is carried out, which shows that our country has the rationality of legalization of euthanasia and the feasibility of the legislative pilot in partial scope. And try to discuss the various details of euthanasia legislation, put forward some strict restrictions on euthanasia, in order to actively regulate and protect euthanasia.
