【摘要】：1898年至1912年間是梁?jiǎn)⒊伤枷氤墒�、完善的一個(gè)重要時(shí)期。這一時(shí)期梁?jiǎn)⒊芯苛酥袊?guó)的傳統(tǒng)法制，提出了完整的“合群—權(quán)利論”思想，，還在歸國(guó)前夕提出了一系列完整的憲政主張。這些構(gòu)成了梁?jiǎn)⒊诹魍鋈毡緯r(shí)期法律思想的主要組成部分。 本文的研究目的在于整理和深入研究梁?jiǎn)⒊诹魍鋈毡緯r(shí)期的法律思想。本文主體分為五個(gè)部分，前四個(gè)部分是：“合群與權(quán)利思想”、“對(duì)中國(guó)傳統(tǒng)法制的研究”、“憲政思想”以及“對(duì)中國(guó)國(guó)家制度的探索”。本文的最后一部分討論了梁?jiǎn)⒊魍鋈毡緯r(shí)期法律思想的特點(diǎn)以及梁?jiǎn)⒊伤枷氲挠绊憽?br/>[Abstract]:From 1898 to 1912, Liang Qichao's legal thought matured and perfected. In this period, Liang Qichao studied the Chinese traditional legal system, put forward the complete thought of "group-right theory", and put forward a series of complete constitutional views on the eve of returning to China. These constitute the main component of Liang Qichao's legal thought during his exile in Japan. The purpose of this paper is to study Liang Qichao's legal thoughts during his exile in Japan. The main body of this paper is divided into five parts. The first four parts are: "the thought of group and right", "the study of Chinese traditional legal system", "the thought of constitutionalism" and "the exploration of Chinese national system". The last part of this paper discusses the characteristics of Liang Qichao's legal thought during his exile in Japan and the influence of Liang Qichao's legal thought.
