【摘要】：從比較憲法學(xué)的角度看,美國(guó)憲法無(wú)論是在政治制度、政治過(guò)程還是在政治認(rèn)同方面,與前現(xiàn)代國(guó)家的君主都具有很大的同構(gòu)性與可比性。因而,美國(guó)憲法是"后君主制"背景的產(chǎn)物。20世紀(jì)初期出現(xiàn)的中國(guó)憲法雖然同樣享有憲法之名,但是,中國(guó)憲法從誕生之時(shí)起,就承擔(dān)了一個(gè)現(xiàn)實(shí)性、功利性的使命:救亡圖存、實(shí)現(xiàn)富強(qiáng)。因而,中國(guó)憲法是作為實(shí)現(xiàn)國(guó)家富強(qiáng)的工具來(lái)期待的。中國(guó)憲法的這種角色,具有深厚的法家背景,是傳統(tǒng)中國(guó)法家學(xué)說(shuō)的產(chǎn)物,也是新戰(zhàn)國(guó)時(shí)代的產(chǎn)物。從根本上說(shuō),法家學(xué)說(shuō)就是對(duì)新戰(zhàn)國(guó)格局的思想回應(yīng)。將中美憲法的政治角色進(jìn)行比較與對(duì)照,可以凸顯中美憲法之間相異的邏輯、語(yǔ)境與背景。
[Abstract]:From the perspective of comparative constitutional law, the constitution of the United States has great isomorphism and comparability with the monarchs of the pre-modern countries, whether in the political system, the political process or the political identity. Therefore, the constitution of the United States is the product of the background of "post-monarchy." although the Chinese Constitution, which emerged in the early 20th century, also enjoys the name of the Constitution, it has assumed a reality from the time of its birth. Utilitarian mission: save the nation and save the nation and achieve prosperity. As a result, China's constitution is expected as a tool to make the country rich and strong. This role of Chinese constitution has a deep background of legalism, is the product of the traditional Chinese legalist theory, but also the product of the New warring States period. Fundamentally speaking, the doctrine of Legalism is the ideological response to the pattern of the New warring States. Comparing and contrasting the political roles of Chinese and American constitutions, we can highlight the different logic, context and background between Chinese and American constitutions.
