【摘要】:作為一個(gè)人口密度高、交通流量大的小國,英國卻是世界上交通狀況最好的國家之一,這除了得益于其良好的社會政策,管理措施等,還要?dú)w功于其完善的交通立法、良好的交通執(zhí)行措施,由其是其對機(jī)動(dòng)車駕駛?cè)税踩⒁饬x務(wù)的嚴(yán)格要求以及對機(jī)動(dòng)車駕駛?cè)素?zé)任的嚴(yán)厲處罰。通過研究英國道路交通中機(jī)動(dòng)車駕駛?cè)饲謾?quán)責(zé)任制度,可以對完善我國道路交通立法提供建設(shè)性的參考。 本論文共分為七部分,第一章引出本文主要內(nèi)容。第二章首先比較中英兩國在機(jī)動(dòng)車駕駛?cè)饲謾?quán)責(zé)任構(gòu)成要件的差異,其中重點(diǎn)比較兩國差異較大的部分,包括機(jī)動(dòng)車駕駛?cè)税踩⒁饬x務(wù)的認(rèn)定以及駕駛?cè)饲謾?quán)行為與受害人所受損害之間因果關(guān)系的認(rèn)定。第三章則比較兩國侵權(quán)駕駛?cè)说膿p害賠償范圍,特別例舉在受害人因傷致殘以及受害人遭受精神損失時(shí)存在的差異。第四章分析侵權(quán)駕駛?cè)说目罐q理由,比較兩國不同的責(zé)任減免情形。第五章則研究道路交通事故中的一種特殊情況,即針對投保駕駛?cè)嗽试S另一未投保駕駛?cè)笋{駛其已投保機(jī)動(dòng)車而后發(fā)生交通事故致前者遭受損害,比較兩國交強(qiáng)險(xiǎn)承包人的賠償范圍。第六章為完善我國的該項(xiàng)制度提出合理的建議,以期為我國創(chuàng)造良好的交通環(huán)境貢獻(xiàn)綿薄之力。最后一章是結(jié)論。
[Abstract]:As a small country with a high population density and a large traffic flow, Britain is one of the countries with the best traffic conditions in the world, thanks not only to its good social policies and management measures, but also to its sound transport legislation. Good traffic enforcement measures are the strict requirements of the duty of attention to the safety of motor vehicle drivers and the severe punishment of the liability of motor vehicle drivers. By studying the tort liability system of motor vehicle drivers in British road traffic, it can provide a constructive reference for perfecting the road traffic legislation in our country. This paper is divided into seven parts, the first chapter leads to the main content of this paper. The second chapter first compares the differences between China and Britain in the constitutive elements of tort liability of motor vehicle drivers, among which the major differences between the two countries are compared. It includes the identification of the duty of safety care and the causal relationship between the torts of the driver and the damage suffered by the victim. The third chapter compares the scope of damage compensation between the two countries, especially the difference between the injured and disabled victims and when the victims suffer mental losses. The fourth chapter analyzes the defense of tort driver, and compares the different liability relief between the two countries. The fifth chapter studies a special situation in road traffic accidents, that is, for the insured driver to allow another uninsured driver to drive his insured motor vehicle and then the traffic accident results in the damage to the former. Compare the scope of compensation between the contractors of traffic insurance in the two countries. The sixth chapter puts forward reasonable suggestions to improve the system in order to create a good traffic environment in China. The last chapter is the conclusion.
