【摘要】：問題邏輯作為應(yīng)用邏輯學(xué)的重要分支，主要任務(wù)就是運用邏輯符號來研究問題與回答這個范圍內(nèi)出現(xiàn)的各種邏輯問題，柯恩作為第一位借助現(xiàn)代邏輯工具研究問題邏輯的學(xué)者，他的研究為我們運用邏輯符號研究實務(wù)部門的問題提供了重要參考。隨后許多學(xué)者將問題邏輯運用到教學(xué)、法庭等多個實務(wù)部門，，產(chǎn)生了一大批有實踐意義的著作。其中問題邏輯在偵查實務(wù)部門中的運用卻很少，偵查訊問作為偵查活動中的關(guān)鍵性環(huán)節(jié)，是訊問人員通過與犯罪嫌疑人面對面的語言交鋒來達到訊問目的的一種偵查手段，其特征即訊問人員與犯罪嫌疑人利用相互交替的問與答，來表達各自的疑問并獲取一定的答案。本文試圖將問題邏輯應(yīng)用到偵查訊問這個問與答的交替過程中，形成研究的中心——訊問問題邏輯，通過分析偵查訊問中的問話與答話的邏輯特征，并形成邏輯推理鏈條，最終提出訊問中問題構(gòu)建的一些方法。 本文主要包括四個部分： 第一部分：“問題”的基本理論。該部分介紹了“問題”產(chǎn)生的原因，“問題”的主要解決模式——問與答的理論研究情況，接著分析了“問題”的詞源和“問題”定義的經(jīng)典說法，如著名學(xué)者的說法和一些較有影響卻存在爭議的說法，如“困難說”、“目標(biāo)說”。最后筆者從生物學(xué)、心理學(xué)、哲學(xué)、邏輯學(xué)等層面綜合分析了自己的問題觀，并介紹了問句的種類和具體情況。 第二部分：問題邏輯的相關(guān)理論。本部分首先關(guān)注了問題邏輯的定義和發(fā)展史，并分析了本文重要的邏輯觀點——預(yù)設(shè)觀點，然后在預(yù)設(shè)觀點的基礎(chǔ)上闡述了問題的邏輯結(jié)構(gòu)和問句的邏輯值。 第三部分：問題邏輯在偵查中的運用。該部分首先從偵查訊問的含義及其分類著手，然后分析預(yù)設(shè)在不同種類問句中的應(yīng)用，進而明確在訊問提綱中如何進行問題推理，如問與問、答與問的銜接問題，最后將問題邏輯具體運用到測謊中，明確問題的提問原則。 第四部分：偵查訊問中問題的構(gòu)建。該部分從為何要構(gòu)建問題入手，分析了應(yīng)答域預(yù)設(shè)在問題構(gòu)建中的關(guān)鍵作用，通過對訊問各個階段不同特點的分析，給出訊問中不同階段的問題構(gòu)建方法，以供我們構(gòu)建訊問中的各個問題，同時為測謊活動提供問題的樣本，以期為偵查訊問提供一些參考。
[Abstract]:As an important branch of applied logic logic, the main task is to use symbolic logic to study the question and answer logic problems within this range, Cohen as the first use logic on the problem of modern logic scholar, his research in logic symbol research practice provides important reference for us. Then many scholars to apply the logic of teaching, the court practice in multiple departments, resulting in a large number of practical works. By the logic in the investigation of the practice of the Department rarely, as a key link of investigation and interrogation in criminal investigation, interrogation is through a means of investigation and criminal suspects face-to-face dialogue to achieve the purpose of the feature that the interrogation, the interrogator and suspect the use of alternating Q to express their questions And get the answers. This paper attempts to alternately applying logic to the interrogation of Q & A, the formation of logic: interrogation problem research center, through the analysis of questioning and answer logic characteristics in investigation and interrogation, and the formation of logical chain, finally puts forward some methods for constructing the interrogation problem.
This article mainly includes four parts:
The first part: the basic theory of "problem". This part introduces the reason of "problem", "problems" which mainly solves the model of Q & a theoretical research situation, and then analyzes the "classic statement" etymology and "problem" defined, such as the famous scholars and some influential but the controversial argument, such as "difficult", "objectives". Finally the author from biology, psychology, philosophy, logic and other aspects of comprehensive analysis of the problems of their own view, and introduces the types of questions and the specific situation.
The second part: the related theories of problem logic. This part first concerns about the definition and development history of problem logic, and analyzes the important logic viewpoint presupposed view. Then, on the basis of presupposition, it expounds the logical structure of questions and logical value of questions.
The third part: the use of logic in the investigation of the start. This part starts from the definition and classification of interrogation, and then analyzes the presupposition application in different kinds of questions, and then clear the outline in the interrogation to problems such as reasoning, ask and ask, ask and answer connection problems, finally will apply to specific logical problems the polygraph, questioning clear principles of the problem.
The fourth part: the construction in interrogation. In this part, why should the construction problems, analyzes the key role of Presupposition in domain response problems in the construction, through the analysis of the various stages of the different characteristics of the construction method of interrogation, the problem of different stages are given for interrogation, we construct various problems in interrogation, and at the same time the problem of providing a sample of polygraph activities, in order to provide some references for interrogation.
