【摘要】：家法族規(guī)是中國傳統(tǒng)法律的重要組成部分,與國家法律具有同源性和互補(bǔ)性。明清時期家法族規(guī)高度發(fā)展并達(dá)到鼎盛,既宣揚(yáng)傳統(tǒng)禮治思想,迎合儒家倫理道德,又配合國家法律實踐,維護(hù)基層社會秩序。文章以歷史文化遺產(chǎn)豐厚的山西為佐證,剖析明清家法族規(guī)合禮合法因素,發(fā)掘、還原家法族規(guī)的歷史價值和現(xiàn)實意義,為積極構(gòu)建一種自上而下的全新社會行為規(guī)范模式提供參考。
[Abstract]:As an important part of Chinese traditional law, the family law rules are homologous and complementary with national laws.During the Ming and Qing dynasties, the family rules and regulations developed and flourished, which not only propagated the traditional rule of etiquette thought, catered to the Confucian ethics and morality, but also cooperated with the national legal practice and maintained the social order at the grass-roots level.Based on the abundant historical and cultural heritage of Shanxi Province, this paper analyzes the legal factors of the family rules of law in the Ming and Qing dynasties, and explores and restores the historical value and practical significance of the rules of the family law clan.It provides a reference for constructing a new model of social behavior norms from top to bottom.
