【摘要】：隨著人類(lèi)科技的進(jìn)步,安樂(lè)死的問(wèn)題受到了越來(lái)越大的關(guān)注。人們?cè)诳紤]“樂(lè)生”的同時(shí),也對(duì)自己的死亡歷程投入了關(guān)注,因而引發(fā)了眾多對(duì)于安樂(lè)死的爭(zhēng)議。而荷蘭和比利時(shí)對(duì)安樂(lè)死合法化的立法,將安樂(lè)死的合法化推向了高潮。作為世界的一員,我國(guó)也對(duì)安樂(lè)死投入了極大的關(guān)注。 本文從先從安樂(lè)死的概念、分類(lèi)和研究狀況對(duì)其進(jìn)行了概述,使人們對(duì)安樂(lè)死有個(gè)總體的了解。然后對(duì)安樂(lè)死從性質(zhì)和正當(dāng)性進(jìn)行分析,以說(shuō)明安樂(lè)死本身具有合法化的理論和倫理基礎(chǔ)。通過(guò)分析我國(guó)安樂(lè)死的現(xiàn)狀,說(shuō)明安樂(lè)死在我國(guó)合法化已經(jīng)具備了一些條件,但目前仍存在很多不利因素,影響安樂(lè)死的合法化。安樂(lè)死畢竟涉及多個(gè)學(xué)科,具有復(fù)雜性,并且其涉及的又是有關(guān)生命的話題,我們必須謹(jǐn)慎對(duì)待。目前安樂(lè)死的合法化雖然還不具備完善的基礎(chǔ),但是其合法化的趨勢(shì)是毋庸置疑的,因此筆者最后提出了關(guān)于安樂(lè)死在我國(guó)的立法構(gòu)想,這也是本文的核心,這部分筆者首先提出了逐步解決我國(guó)安樂(lè)死合法化的不利因素,而后通過(guò)對(duì)安樂(lè)死立法原則、實(shí)施條件以及違法安樂(lè)死的法律責(zé)任的說(shuō)明對(duì)安樂(lè)死的立法進(jìn)行了闡述。
[Abstract]:With the progress of human science and technology, euthanasia has been paid more and more attention.People also pay attention to their own death course while considering "happy life", which has aroused a lot of controversy about euthanasia.The Dutch and Belgian legislation on legalization of euthanasia brought euthanasia to a climax.As a member of the world, China has also devoted great attention to euthanasia.In this paper, the concept, classification and research status of euthanasia are summarized in order to make people have a general understanding of euthanasia.Then it analyzes the nature and legitimacy of euthanasia to illustrate that euthanasia itself has the theoretical and ethical basis of legalization.By analyzing the present situation of euthanasia in China, it is shown that there are some conditions for legalization of euthanasia in our country, but there are still many unfavorable factors which affect the legalization of euthanasia.Euthanasia, after all, involves multiple disciplines, complexity, and life-related topics that we must be cautious about.Although the legalization of euthanasia is not perfect at present, the trend of legalization of euthanasia is beyond doubt. Therefore, the author finally puts forward the legislative conception of euthanasia in our country, which is also the core of this paper.This part of the author first proposed to gradually solve the disadvantages of euthanasia legalization in China, and then through the principles of euthanasia legislation, implementation conditions and the legal liability of illegal euthanasia, euthanasia legislation is expounded.
