【摘要】：弘揚和培育社會主義法治精神是伴隨依法治國進程產生的重大命題。2005年中央首次明確提出“弘揚法治精神”。隨后黨的十七大強調要“深入開展法制宣傳教育,弘揚法治精神,形成自覺學法守法用法的社會氛圍�！秉h的十八大進一步明確了弘揚法治精神的目標要求,即“樹立社會主義法治理念,增強全社會學法尊法守法用法意識�！笔藢盟闹腥珪窃邳h的歷史上首次專題討論依法治國問題。至此,弘揚和培育社會主義法治精神,已逐漸成為新時期全面推進依法治國戰(zhàn)略的重要任務。完成好這一任務,關鍵在于探索建構一套行之有效、持之以恒的建設機制,使法治成為全體社會成員的基本行為規(guī)范,確保法治國家、法治政府、法治社會三位一體、同步實現(xiàn)。那么,這一機制的內在構成是什么?影響和制約機制建設的因素有哪些?建設的重點難點切入點在哪里?這些都是我們亟待解決的重要問題。圍繞上述問題,本研究以馬克思主義為指導,運用文獻分析、定性分析、系統(tǒng)分析等研究方法,通過厘清社會主義法治精神及其相關基本概念的學理內涵,梳理建國以來我國法制建設及法治精神的發(fā)展歷程,從整體上對社會主義法治精神培育的過程機理進行系統(tǒng)把握,并從我國的傳統(tǒng)文化遺留、現(xiàn)實的法治自覺阻力和西方法治思想的滲透影響等方面,分析當前中國社會存在的有礙于社會主義法治精神培育機制建構的各類影響因素,在此基礎上提出了建立社會主義法治精神培育機制的理論架構和基本策略。全文除導論和結語外共分為六章、四部分內容:第一部分是論文的第一章,重在解決“倡導建立社會主義法治精神培育機制的邏輯依據是什么”問題,包括概念辨析、歷史梳理及實質探析三個方面。在厘定法治精神相關概念的基礎上,簡要梳理建國以來我國法治建設的基本歷史脈絡,指出社會主義法治精神培育是在繼承我國法治建設成果基礎上提出的更深層更根本的法治中國建設要求。然后進一步分析指出社會主義法治精神培育實質上是個涉及全體國民的生成性過程,內在遵循主體同構、過程疊加、真善合一、知行融通的基本邏輯,需要通過建立一套行之有效的培育機制才能夠真正實現(xiàn)。第二部分是論文的第二章,重在辨析影響和制約社會主義法治精神培育機制建立的歷史和現(xiàn)實因素。歷史維度,重在分析中國傳統(tǒng)文化中形成的“禮法合治”、“法自君出”以及“執(zhí)法原情”等法治傳統(tǒng)與現(xiàn)代法治觀具有內在的理念沖突,一定程度上成為制約社會主義法治精神培育機制建立的思想性障礙。現(xiàn)實維度,重在從國內國際兩方面入手探討當下中國所面臨的法治精神培育阻力。國內方面主要探討了公民法治意識淡薄問題、司法公信力問題;國外方面主要探討了中國立場與西方取向的博弈問題以及西方文化產品的涌入和負面影響問題。第三部分是論文的第三章,主要從理論層面對社會主義法治精神培育機制做出基礎性分析,嘗試提出這一機制建設的基本原則和總體思路。指出社會主義法治精神培育機制建設必須遵循秩序維護與教化育人相結合、行為規(guī)范與精神塑造相結合、知識傳輸與價值導向相結合、氛圍營造與個別引導相結合的總體思路,找準建構的重點、難點及切入點。第四部分是論文的主體部分,包括第四、五、六章內容,主要是從實踐層面提出社會主義法治精神培育長效機制建設的基本策略。主要包括建立“權責清晰,角色準確”的主體定位機制,建立“理論創(chuàng)新,知行合一”的實施機制,建立“制度管理,規(guī)范運作”的保障機制。具體來說,首先著重分析了“決策-導向”、“闡釋-深化”、“傳播-普及”三類主體在社會主義法治精神培育過程中的角色與責任定位;然后從思想導向、利益驅動、傳播認同等維度探討分析社會主義法治精神的實施機制;最后提出了社會主義法治精神培育的政策、人才與財政保障機制,旨在為社會主義法治精神培育有效性和常態(tài)化提供有力保障。
[Abstract]:Carry forward and cultivate the spirit of socialist rule of law is the important proposition in the process of the rule of law with.2005 from the central first explicitly proposed "to promote the rule of law. Around these issues, in this study, the Marx doctrine as a guide, the use of literature analysis, qualitative analysis, system analysis and other research methods, through clarifying the spirit of socialist rule of law and the basic concepts related to theoretical connotation, the development process of China's legal system and the rule of law review since the founding of new China, the process mechanism of the cultivation of the spirit of socialist rule of law as a whole to grasp, and from the traditional cultural legacy of our country, the rule of law consciousness of resistance and the western law thought reality penetration effect, analysis of the current Chinese social existence The hindrance to the socialist rule of law and cultivate the spirit of the various factors affecting the construction mechanism, put forward based on the theoretical framework of establishing the socialist rule of law cultivation mechanism and basic strategies. The fourth part is the main part of the paper, including fourth, fifth. The six chapter, mainly from the basic strategy of practice put forward the spirit of socialist rule of law cultivation. Mainly includes the construction of long-term mechanism "The establishment of clear responsibilities, the main role of accurate positioning mechanism", "the establishment of theoretical innovation, implementation mechanism and the establishment of management system, standardized operation safeguard mechanism." specifically, firstly focuses on the analysis of the "decision - oriented", "interpretation deepening", "spread the popularity of" three kinds of main body in to cultivate the spirit of socialist rule of law role and responsibility in the process of positioning; then benefit from the ideological orientation, drive, communication and other dimensions of identity implement mechanism analysis of the spirit of socialist rule of law; finally put forward the socialist rule of law spirit cultivation policy, talent and financial guarantee mechanism, to effectively and normalized to cultivate the spirit of socialist rule of law to provide effective protection.
