【摘要】：正一、侵犯專有出版權(quán)的行為造成著作權(quán)人經(jīng)濟(jì)損失的,著作權(quán)人有權(quán)要求賠償柏楊將其《柏楊版資治通鑒》的著作財(cái)產(chǎn)權(quán)贈(zèng)與郭張香華。2005年,柏楊與邦道文化公司簽訂《圖書出版合同》,授權(quán)邦道文化公司在該作品出版之日起5年內(nèi)在中國(guó)大陸以圖書形式獨(dú)家出版《柏楊版資治通鑒》的專有權(quán)利。邦道文化公司以版稅方式支付稿酬。合同有效期內(nèi),若邦道文化公司有意向第三方轉(zhuǎn)授權(quán)時(shí),應(yīng)事前獲得柏楊的書面許可。2011年11月法院終審判決解除上述合同。
[Abstract]:First, if the infringement of exclusive publishing rights results in the economic loss of the copyright owner, the copyright owner shall have the right to claim compensation for the property right of Bai Yang to grant to Guo Xianghua the property right of his book "Bai Yang Edition Zi Zhi Tong Jian". 2005, Boyang signed a book publishing contract with Bang Tao Culture Company, authorizing Bang Dao Culture Company to publish exclusively in the form of books in mainland China within 5 years from the date of publication of the work. Cultural companies pay for manuscripts in the form of royalties. During the term of the contract, If Bandao Culture Company intends to transfer the authority to a third party, it should obtain the written permission of Bai Yang in advance. November 2011, the Court of final Appeal rescinded the above contract.
