【摘要】：目前,在對(duì)法治與法治國(guó)家的理解上,還存在一些歧義;在如何通達(dá)法治狀態(tài)的實(shí)踐路徑上,也還存在一些模糊的甚至扭曲的認(rèn)識(shí)與做法,因此有必要對(duì)此加以分析以正本清源。法治的構(gòu)成要件包含形式的、控權(quán)的、觀念的、認(rèn)知的和精神的方面,分別考察法律體系是否健全、法律是否對(duì)權(quán)力體系作出了嚴(yán)密的規(guī)制、權(quán)利本位觀念是否養(yǎng)成、"善法為治"和"法律至上"是否升華為社會(huì)主體守法的內(nèi)驅(qū)力、法治經(jīng)緯中的精神因子的存在的狀況等。對(duì)法治的基準(zhǔn)性衡量要素的考察與總括,有助于厘清法治的本源與基礎(chǔ),確保法治的正確方向不被改變,法治國(guó)家建設(shè)不會(huì)半途而廢。
[Abstract]:At present, there are still some ambiguities in the understanding of the rule of law and a country ruled by law, and there are still some vague and even distorted understandings and practices on how to understand the practice of the state of the rule of law. Therefore, it is necessary to analyze this in order to clarify the source. The constituent elements of the rule of law include formal, controlling, conceptual, cognitive and spiritual aspects, and examine separately whether the legal system is sound or not. Whether the law has made strict regulations on the power system, whether the concept of right standard has been nurtured, whether "good law is governing" and "law supreme" is sublimated as the driving force of the social subject to abide by the law. The investigation and summary of the basic measuring elements of the rule of law is helpful to clarify the origin and foundation of the rule of law, to ensure that the correct direction of the rule of law will not be changed, and that the construction of the country ruled by law will not be abandoned halfway.
