【摘要】：巡回法庭制度起源于英國.在世界范圍內(nèi),各國學(xué)者大都以英國的巡回法庭制度作為研究對象。英國巡回法庭制度的成功實施,加強(qiáng)了中央集權(quán),維護(hù)了司法統(tǒng)一,吸收了地方習(xí)慣法,削弱了地方勢力,為英國以普通法為主的現(xiàn)代司法體系的形成起到了重要作用。我國司法目前飽受"行政化"和"地方化"的困擾,司法權(quán)的統(tǒng)一性、系統(tǒng)性難以在地方上有效實施。借鑒英國巡回法庭制度的經(jīng)驗,在我國巡回法庭成立的初期階段,也不失為一個明智的選擇。
[Abstract]:The circuit court system originated in the United Kingdom. In the world, most scholars take the British circuit court system as the research object. The successful implementation of the British circuit court system strengthened the centralization of power. It maintains judicial unity, absorbs local customary law and weakens local forces. It has played an important role in the formation of the modern judicial system in Britain, which is dominated by common law. At present, our country's judicature is beset by "administration" and "localization", and the unity of judicial power. It is difficult for the system to be implemented effectively in local areas and it is a wise choice to learn from the experience of the British circuit court system in the initial stage of the establishment of the circuit court in our country.
