論“父為子隱,子為父隱,直在其中”

【摘要】:在過去十多年間,學(xué)術(shù)界圍繞"父子相隱"問題就儒家倫理展開了一場(chǎng)學(xué)術(shù)爭(zhēng)鳴。一方認(rèn)為,父子相隱合乎天理人情;另一方則認(rèn)為,父子相隱違法悖德。雙方對(duì)父子相隱的評(píng)價(jià)勢(shì)不并立,但對(duì)父子相隱的理解卻是相同的,即都認(rèn)為父子相隱是互隱其惡,都認(rèn)為孔子把親親隱惡視為"直"德。但細(xì)致地考察《論語》以及相關(guān)文獻(xiàn)則發(fā)現(xiàn),上述理解乃是對(duì)孔子的一個(gè)誤讀?鬃铀^"父為子隱,子為父隱"并非相互隱惡,而是意指正義的家庭屬性和主動(dòng)的道義擔(dān)當(dāng)。"父子相隱,直在其中",并非主張徇情枉法或漠視社會(huì)公德,而是旨在提示一條破解"孝(慈)義兩難"問題的德性之路。
[Abstract]:In the past ten years, the academic circles have launched an academic controversy over Confucian ethics around "father-son concealment". One side believes that father and son concealment is in accordance with nature, the other side believes that father and son hidden illegal contrary to morality. The two sides' evaluation of father and son's concealment is incongruous, but their understanding of father and son's concealment is the same, that is to say, they both think that father and son's covert is mutual hidden evil, both think that Confucius regards relatives and relatives' hidden evil as "straight" virtue. However, a careful examination of Analects and related literature shows that the above understanding is a misreading of Confucius. Confucius said that "father as son, son as father" is not mutual evil, but refers to the family attribute of justice and active moral responsibility. Father and son are hidden from each other ", not advocating favoritism or ignoring social morality, but pointing out a moral way to solve the problem of" filial piety (kindness) and righteousness dilemma ".
