【摘要】：網(wǎng)絡(luò)刪帖是國際通用的網(wǎng)絡(luò)管控手段。網(wǎng)絡(luò)刪帖屬于新聞(信息)傳播"刊后追懲制"范疇,呈現(xiàn)出即時性、規(guī)�；⑸虡I(yè)化、智能化等特點(diǎn)。不當(dāng)刪帖和有償刪帖危害社會和網(wǎng)絡(luò)環(huán)境,由此應(yīng)建構(gòu)起網(wǎng)絡(luò)刪帖行為的邊界:涉嫌違法犯罪的有償刪帖應(yīng)明令禁止、依法打擊;網(wǎng)絡(luò)刪帖與表達(dá)自由的平衡可參照"明顯而即刻危險"原則;完善法律規(guī)制、行業(yè)自律和監(jiān)督機(jī)制是網(wǎng)絡(luò)刪帖科學(xué)化的有力保障;規(guī)范的刪帖流程是防止網(wǎng)絡(luò)刪帖越界和刪帖權(quán)利濫用的具體路徑。
[Abstract]:The network delete post is the international common network management and control means. The censored posts on the Internet belong to the category of news (information) dissemination, which shows the characteristics of immediacy, scale, commercialization, intelligence and so on. Improper deletion and paid deletion of posts endanger the social and network environment, so we should construct the boundary of the behavior of deleting posts on the network: the paid deletion of posts suspected of illegal crimes should be explicitly prohibited and dealt with according to law; The balance between online post deletion and freedom of expression can be referred to the principle of "obvious and immediate danger", perfect legal regulation, industry self-discipline and supervision mechanism are the powerful guarantee of scientific network post deletion. The standard process of deleting posts is the specific way to prevent the network from overstepping the limits and abusing the right to delete posts.
