【摘要】：確定大數(shù)據(jù)時代的個人數(shù)據(jù)保護(hù)與開發(fā)利用并重理念,即開發(fā)利用個人數(shù)據(jù)使其增值與加大法律保護(hù)的深度與力度具有劃時代的意義。文章運(yùn)用歷史研究法與文獻(xiàn)分析法,對個人數(shù)據(jù)權(quán)的起源、形成與發(fā)展階段進(jìn)行分期;梳理隱私權(quán)與網(wǎng)絡(luò)隱私權(quán)、個人信息權(quán)、個人數(shù)據(jù)權(quán)等相關(guān)概念的聯(lián)系與區(qū)別;歸納不同時期國內(nèi)外學(xué)者對個人數(shù)據(jù)保護(hù)與開發(fā)的代表性觀點(diǎn)及各國相關(guān)立法或判例。
[Abstract]:It is of epoch-making significance to determine the concept of equal emphasis on personal data protection and development and utilization in big data's time, that is, to develop and utilize personal data to increase its value and to increase the depth and intensity of legal protection.This paper uses the method of historical research and literature analysis to divide the origin, formation and development stage of personal data right, combing the connection and difference between privacy right and network privacy right, personal information right, personal data right and so on.This paper summarizes the representative views of domestic and foreign scholars on personal data protection and development in different periods and the relevant legislation or precedents of various countries.
