【摘要】：正大數(shù)據(jù)作為一種"資產(chǎn)",其權(quán)屬問(wèn)題仍未納入法律保護(hù)與監(jiān)管范圍。大數(shù)據(jù)產(chǎn)業(yè)發(fā)展、文化傳承和社會(huì)記憶的留存均亟待大數(shù)據(jù)權(quán)屬的立法界定。充分認(rèn)識(shí)大數(shù)據(jù)的資產(chǎn)性質(zhì)是發(fā)展大數(shù)據(jù)產(chǎn)業(yè)的觀念基礎(chǔ)。近年來(lái),大數(shù)據(jù)正在成為新的經(jīng)濟(jì)增長(zhǎng)點(diǎn),人們已經(jīng)認(rèn)識(shí)到它的"資源"屬性,甚至看成是"未來(lái)的新石油"。然而,隨著大數(shù)據(jù)的市場(chǎng)化利用和產(chǎn)業(yè)化發(fā)展,其另一個(gè)特征——"資產(chǎn)"屬性日益凸顯,大數(shù)據(jù)的權(quán)屬關(guān)系即將成為新的社會(huì)矛盾和經(jīng)濟(jì)糾紛焦點(diǎn)。
[Abstract]:As a kind of "asset", the ownership problem of the big data is still not included in the scope of legal protection and supervision. The development of large data industry, cultural heritage and the retention of social memory need to be defined by the legislation of large data ownership. To fully understand the nature of the large data assets is the conceptual basis for the development of the large data industry. In recent years, big data is becoming a new economic growth point. People have recognized its "resource" property, even as "the new oil in the future". However, with the market utilization and industrialization development of big data, another feature, the property of assets, is becoming increasingly prominent. The ownership relationship of big data will soon become the focus of new social contradictions and economic disputes.
