【摘要】：對小說《苔絲》中的法律事件和法律行為進行分析會發(fā)現(xiàn),苔絲的悲慘命運的每一個轉(zhuǎn)折都和英國當時的法律制度密切相關。英國當時的侵權法實行的是過錯責任原則,導致苔絲家的馬被郵車撞死而郵局和郵差不負賠償責任,致使苔絲一家陷入經(jīng)濟困境;苔絲被亞雷克強奸使苔絲失去了維多利亞時代婦女幸�；橐龅幕緱l件;苔絲懷孕生子是當時禁止墮胎的法律規(guī)定使苔絲失身的事情被公之于眾,加重了苔絲被強奸的悲劇后果;由于對當時離婚法律制度的誤解導致苔絲同意與克萊爾結婚并在新婚之夜被拋棄;當時英國的土地法律制度導致苔絲的父親死后全家人流離失所;苔絲殺死亞雷克后,不公正的刑事法律結束了苔絲的生命�？梢哉f,正是英國維多利亞時期的法律把像苔絲這樣的破產(chǎn)農(nóng)民帶入了悲劇的深淵。
