【摘要】：1975年，加利福尼亞大學(xué)伯克利分校心理學(xué)教授埃莉諾·羅施(Eleanor Rosch)在心理學(xué)實(shí)驗(yàn)中提出了原型理論。此后，該理論被廣泛應(yīng)用于認(rèn)知心理學(xué)及翻譯實(shí)踐。在原型理論視角下，，翻譯被視作在一定時(shí)空條件下尋找最佳目的語樣例的活動(dòng)；一種通過識(shí)別原語原型，尋找目的語讀者心中原型，進(jìn)而依據(jù)目的語原型重塑原語原型的過程。 鑒于此，原型理論為法律翻譯開辟了新視野。本文以原型理論為框架，以“法”字的翻譯為例，力圖從以下幾個(gè)方面探究“法”字的原型及其在翻譯中原型效應(yīng)的呈現(xiàn)。首先，從詞源、語義含義、語用含義三個(gè)層面建構(gòu)“法”字的原型，通過識(shí)解發(fā)現(xiàn)其原型存在范疇化的特性。其次，本文嘗試性地提出凸顯“法”字原型的翻譯過程，認(rèn)為“法”字的翻譯即是對(duì)其原型識(shí)解及建構(gòu)的過程：依據(jù)“法”的含義將其劃分為上位范疇、基本范疇、下位范疇，據(jù)此尋找不同范疇中的原語原型，建構(gòu)對(duì)應(yīng)范疇中目的語讀者原型，并重建原語以理解發(fā)現(xiàn)對(duì)應(yīng)目的語中的原型。再次，本文針對(duì)翻譯中實(shí)際原型與理想原型的偏離，使用了認(rèn)知域轉(zhuǎn)移、范疇一致性、文化補(bǔ)償、描述性解釋的翻譯策略。 總之，原型理論為法律翻譯理論的構(gòu)建及法律翻譯實(shí)踐提供了行之有效的方法。本文旨在從認(rèn)知語言學(xué)角度出發(fā)探索法律翻譯，從而起到拋磚引玉、另辟蹊徑的目的，以期為今后法律英語翻譯貢獻(xiàn)一份綿薄之力。
[Abstract]:In 1975, Eleanor Rosch, a professor of psychology at the University of California, Berkeley, put forward prototype theory in psychological experiments.Since then, the theory has been widely used in cognitive psychology and translation practice.From the perspective of archetypal theory, translation is regarded as the activity of finding the best sample of the target language under certain time and space conditions; a process of reconstructing the prototype of the target language according to the prototype of the target language by identifying the prototype of the source language and looking for the prototype in the heart of the target language reader.In view of this, prototype theory opens up a new perspective for legal translation.Taking the prototype theory as the framework and the translation of the word "law" as an example, this paper tries to explore the prototype of the word "law" and its prototype effect in translation from the following aspects.Firstly, the prototype of the word "law" is constructed from three levels: etymology, semantic meaning and pragmatic meaning, and the characteristics of categorization of its archetypal existence are found through understanding.Secondly, this paper tries to put forward the translation process of protruding the archetype of "law", and holds that the translation of "law" is the process of understanding and constructing its prototype: it is divided into the upper category, the basic category and the lower category according to the meaning of "law".Based on this, we seek the prototype of the target language in different categories, construct the prototype of the target language in the corresponding category, and reconstruct the source language to understand and find the prototype in the corresponding target language.Thirdly, in view of the deviation between the actual prototype and the ideal prototype in translation, this paper uses translation strategies such as cognitive domain transfer, category consistency, cultural compensation and descriptive interpretation.In a word, prototype theory provides an effective method for the construction of legal translation theory and the practice of legal translation.The purpose of this paper is to explore legal translation from the perspective of cognitive linguistics so as to serve as a starting point and to explore a new way to contribute to the translation of legal English in the future.
