【摘要】：隨著科技的進(jìn)步與互聯(lián)網(wǎng)的迅猛發(fā)展,網(wǎng)絡(luò)域名逐漸成為新的重要資源,但網(wǎng)絡(luò)域名在給人們帶來巨大利益的同時,也引起了諸多問題。然而我國有關(guān)網(wǎng)絡(luò)域名的立法卻存在不足甚至缺失,使得網(wǎng)絡(luò)域名管理成為難題。而隨著網(wǎng)絡(luò)域名的發(fā)展,針對其展開的交易和服務(wù)也漸漸興起,由于這些業(yè)務(wù)在傳統(tǒng)業(yè)務(wù)的形式和特點(diǎn)之外,更具有一定的特殊性,因此無法完全適用傳統(tǒng)業(yè)務(wù)的法律法規(guī),甚至在某些問題上存在法律規(guī)制的空缺與矛盾,不利于網(wǎng)絡(luò)域名資源的合理利用與網(wǎng)絡(luò)管理的良性運(yùn)行。本篇論文主要分為四部分,包括：第一部分對網(wǎng)絡(luò)域名進(jìn)行概述,對網(wǎng)絡(luò)域名及域名權(quán)的性質(zhì)進(jìn)行法律界定;第二部分分析我國網(wǎng)絡(luò)域名立法與實(shí)踐中存在的主要問題,并展開討論網(wǎng)絡(luò)域名業(yè)務(wù)中可能存在的法律問題,在此基礎(chǔ)之上探析對其進(jìn)行法律規(guī)制與保護(hù)的必要性；第三部分主要分析各國及國際組織的相關(guān)立法,并根據(jù)我國實(shí)情,提出可借鑒之處；第四部分則針對第二部分的分析結(jié)果,借鑒第三部分國外相關(guān)立法經(jīng)驗(yàn),結(jié)合我國司法實(shí)踐與實(shí)際國情,提出法律建議,因此該部分為本篇論文的重點(diǎn)研究部分。
[Abstract]:With the development of science and technology and the rapid development of the Internet, the Internet domain name has gradually become a new important resource, but the network domain name not only brings great benefits to people, but also causes a lot of problems. However, there are some deficiencies or even deficiencies in the legislation of internet domain names in our country, which makes the management of domain names become a difficult problem. With the development of the network domain name, the transaction and service for the domain name are also rising gradually. Because these services have some particularity besides the form and characteristics of the traditional business, they can not be fully applied to the laws and regulations of the traditional business. Even in some problems, there are gaps and contradictions in legal regulation, which is not conducive to the rational use of network domain name resources and the benign operation of network management. This paper is mainly divided into four parts, including: the first part of the outline of the network domain name, the nature of the domain name and domain name rights of the legal definition; the second part analyzes the main problems in the legislation and practice of the network domain name in our country. And discuss the possible legal problems in the network domain name business, on this basis to explore the necessity of its legal regulation and protection; the third part mainly analyzes the relevant legislation of countries and international organizations, and according to the facts of our country, The fourth part aims at the analysis results of the second part, draws lessons from the third part of the relevant foreign legislative experience, combined with the judicial practice and the actual situation of our country, put forward legal suggestions, Therefore, this part is the key research part of this paper.
