【摘要】：最高人民法院《關(guān)于審理不正當競爭民事案件應用法律若干問題的解釋》對知名商品特有包裝、裝潢的認定標準作出了比以往法律更為具體的規(guī)制,但適用中仍然存在許多問題。對在先知名商品的認定應進行綜合認定并且以知名度為認定核心,進一步明確主觀要件在侵權(quán)認定中的作用,區(qū)分反不正當競爭法與知識產(chǎn)權(quán)專門法律在適用范圍上的差別,防止《反不正當競爭法》適用范圍的不當擴大。
[Abstract]:The Supreme people's Court [the interpretation of some issues concerning the application of the law in handling civil cases of unfair competition] has made more specific regulations on the special packaging and decoration standards of well-known commodities than on previous laws.However, there are still many problems in the application.The identification of well-known goods before should be comprehensively identified and the recognition of popularity as the core, further clarify the role of subjective elements in the identification of infringement, distinguish the difference between anti-unfair competition law and special law of intellectual property rights in the scope of application.To prevent the improper expansion of the scope of application of the Anti-unfair Competition Law.
